That’s true, once you say you have traffic in sight or request a visual approach, the controller is no longer responsible for separation. Of course a controller will warn of other traffic. The helicopter wouldn’t t have lied when they said they had traffic in sight but what traffic, were they looking at a different aircraft? Many unanswered questions here. Remember, it was dark, all they are going to see is nav lights and strobes, you can’t actually identify an aircraft type.
