To criminally prosecute someone, you need more than hearsay. It is possible that Gaetz did these things and spoke of it but that there are no breadcrumbs tying him to it. I do not know. When we refer someone to the State AG for UI fraud, we use more than witnesses.

You cannot be arrested for being under the influence of drugs which is why cops regularly bring high/stoned/doped up people to the hospital but don’t arrest them.  

You only get arrested if authorities find the drugs in your possession

This was an ethics report. Maybe the DoJ will use the evidence in this report to investigate and charge. You can violate ethics without breaking the law, depends what the rules are. Because Gates resigned from Congress, the house can't do anything to him. 

Bear in mind that the committee is made up of ten members, 5 from each party so at least one Republican had to sign off on releasing this report and it sounds like all of them did.
