I think he can, but apparently needs to be impeached first according to the Office of Legal Counsel's memo stating that POTUS cannot be charged while IN OFFICE. The Constitution states a PRMARY duty of the POTUS is to "take care that the laws be faithfully executed". This means the President must ensure that laws passed by Congress are implemented and enforced by the executive branch. Which is inconsistent with OBSTUCTING the enforcement of laws.
