If it is true that he cannot be prosecuted then that's the end of the discussion - nobody wants to go through a prosectution, ESPECIALLY if they're innocent. Of course his lawyer would try to get it thrown out. It's silly to suggest that defending yourself in court proves you're guilty, yeash!!!!!

We will never see the day when Trump gets prosecuted for anything because he has not committed any crime. All charges being brought against Trump will go nowhere. Apparently the lying prosecutor Smith wants to have a speedy trial set up and over before the next election rolls around to see if he can nail Trump on something before the next election. Under normal circumstances this trial should go ahead way after the election. But the rats like Smith have to try and nail Trump before the election. Fools like you just seems to be everywhere. Someone forgets the simplest concepts of how law works. If there's evidence of lawbreaking then you investigate. You don't fish for evidence without any idea of what crime was committed.

When a court finds you guilty of fraud, you are guilty. When you claim your house was worth $1 million dollars on your 1973 taxes when it wasn't and plead it is worth that now you admit to have committed fraud.

the plan involves getting sets of electors in to sign Electoral College certificates of ascertainment in select states that Trump needed to win. Chesebro is now spilling the beans about this and how he briefed Trump himself:

sending those certificates to congress and then having Pence delay certification based on the existence of those certificates.

all with the intention of preventing the lawful certification of Biden.

And it is generally referred to as civil fraud - but that has nothing to do with "fraud" as we know it.  It's not a criminal case.

In fact in this case there isn't even an offended party. This is strictly a fine from the state, no bank or lender or anyone else at all is claiming there was any problem here. And as i noted - the judge did not hear evidence on whether or not it was fraud, civil or otherwise.  The  judge accepted the state's claim that it was a case of civil fraud without challenge and moved on to determining what the penalty should be, which is what the case was about.

Tonnes of actual real estate experts have come out and said the claim he overvalued the property is not credible, and that properties like that are almost impossible to assess because they're so unique and that the state tax department uses an ENTIRELY different valuation method including what the income from the property is. So if the club doesn't make money one year the valuation nosedives. They also noted that while there were factual errors in his submissions thats pretty common and the banks were allowed to verify the physical properties if they wished and in any case you still can't assess it's value like a normal property.

So - not convicted of fraud, not even tried for fraud, the judge accepted the state's claim that it was 'civil fraud' meaning nobody was actually defrauded, but you can face penalties.

But people with motive to dislike him say things like "He was CONVICTED of FRAAAAUUUUUDDDDD'!!!!!!!! (hang him!!!!)

You can't get 'convicted ' of a civil offense. He was not tried for fraud, the judge was there to assess penalties for what the state claimed was civil fraud and that was never tried in court.

This is like getting a speeding ticket and having to pay a fine,  and someone claiming you were convicted of criminal negligence operating a motor vehicle

Irrelevant.  Anyone who commits a crime should be prosecuted.  You can read the Trump indictments for yourself. They’re all public record and the prosecutors explain the crimes, list the evidence and state which laws were broken in commission of the crime.
