Section 35 and the many treaties already provide for the fiduciary responsibility to First Nations. There has been a defacto recogintion of self government for 2o years, for those many First Nations who want much more control of their resources. The feds have in many ways stepped away from the relentless paternalism that has failed for a century or two. Self government has not solved everybodys woes, for sure, but it suits many First Nations far better than the alternative. All this takes time, but overall things are moving along considering many First Nations are missing a generation or two of leadership. -

There are two faces to such rulings. On one hand, it could be a strong lever to guarantee aboriginal economic participation and control over their traditional territory, assuming they can get an aboriginbal title certified. On the other hand, it could be a crushing blow to development in those places that want develpopment. Just owning or controlling the land does not guarantee prosperity. Large whacks of capital will be invested where the investors have a return. If it looks like too much hassle or not enough return, resource companies just go invest somewhere else. There are always plenty of candidate projects globally. I hope the former applies, but it is far from certain. -

She was negligent in her actions, and that negligence resulted directly in the deaths of two persons. In the cirumstances, a conviction and a suspended sentence would be appropriate. Nothing would be served by a long jail sentence. -

Link does not work. Thanks for trying though, this is an important decision either way. Teh strength of the claim to title was important here, and also critical was that the rights to fish hunt and occupy did not mean that First Nations automatically had exclusive rights to completely control land or its development. -
Ivory Coast must be devastated by being cheated out of a future at the Word Cup. For those who missed it, Greece and Cote d'Ivoire were tied at the very end of the game. With a tie, CIV would advance and Greece would be eliminated. Right in front of the CIV goal a Greek player stumbled over his own feet and a penalty kick resulted in a Greek win as the game ended right after. Replays clearly showed that the CIV player never touched the Greek player, much less committed a foul that warranted penalty kick. At the highest levels, soccer is a joke.

The right of First Nations to self government is not addressed in the Constitution, but the Government of Canada has had policies recognizing First Nations self governance since about the mid 90s. There are over 600 First Nations in the country now. I agree that the feds would like to avoid Supreme Court challenges on this. There are other reasons for this avoidance too, other than Constitutional. -
He was suspended for 7 games in 2010 and ten games in 2013 for biting opponents. Both times it was by his league. I fully expect FIFA to do nothing because of his stature. He already has a guest appearance on The Walking Dead scheduled.

Why would you imply that treaties are somehow supreme, when in fact the treaty rights of First Nations are part and parcel of our Constituion? That is not an opinion. Your inference that guarantees of First Nations rights are somehow subservient to the Constituion is wrong and misleading. They are part of the Constitution. -

Not really, since you don't go on to note that Harper has also said MPs can vote their conscience on what he sees as issues of conscience. An example fo that was the most recent same sex marriage vote, in which the PCs were not whipped. The NDP did whip all members, the Liberals whipped their Cabinet. There's the difference: Trudeau states his MPs and any Liberal candidates must support abortion on demand if and when the question arises. . Harper says you can hold whatever view you like, but his government won't put the question to Parliament , so the question won't arise where it matters most. -

Your comparison of India an Pakistan has no validity. You are obviously not aware that India is a fast growing economy, and that includes a burgeoning middle class. Pakistan is a monotheistic Islamic nation, India is incredibly diverse ethnically and religiously . India is an actual functioning democracy, Pakistan is..... Do indians have a choice? Yes they do, and they exercise it enthusiastically and frequently in elections and governments. Compare Pakistan to countries of similarly sized economies and vaguely similar societies, like Egypt, Algeria, Kazahkstan or Nigeria.

I don't think the number of referees or having access to appeals on calls in the prime problem with officiating at the World Cup. The bigger problem is the quality of the officials. FIFA wants to have everybody represented: nations, continents, races, leagues etc. That means they have a wide cross section of humanity blowing a whistle, it does not mean they have the best refs at the tournament. They should be using only pro level officials selected solely on merit.

Your entire life in Canada is an acquired advantage. Another fact that will chap the collective ass: First Nations groups often get to define their own membership. Imagine. -
I was correcting the assertion that BC is "The West". It's part of the West, and not even the furthest West. It's not the Lower Mainland taxes that increase the fuel cost, it's the carbon tax everywhere in the province. People living in the Peace Country(yes that is part of BC though well outside the LM) travel regularly to Grande Prairie in AB to fill Tidy Tanks with fuel.

TAPS has long sections built above ground, about half the total length. The principal reason is permafrost conditions. There is no permafrost on the Gateway route. There are also four relatively short aboveground sections related to earthquake protection on known faultlines. -
Yes, Yukon is further west than BC. Consult a map. Gas prices in that remote place are less than in BC, despite all the fuel actually coming via BC by truck. You're not broke at the moment in BC, but if history holds true that is temporary.

No, their pitching is demonstrably shitty. They have exactly one pitcher in the top fity in MLB in ERA(Buehrle). One. Their team ERA is 23rd in the league. First place team, 23rd best in ERA!!! Their entire staff has one complete game. The reason their pitching looked adequate before is because they were getting massive run support. Now they are not, and they are exposed. If the pitchers get average run support, the Jays lose. They are also getting badly outcoached on many nights. Gibbons obviously leaves veteran guys like Dickey and Buehrle in the game too long. He has also fallen prey to Cito Gaston Syndrome, whereby you sit on the bench watching with your thumb up your ass, waiting and praying for that game winning three run homer.. The Jays have some guys who can run the bases. But we rarely see Gibbons trying to win close games with some strategy. We rarely hit and run, steal, bunt, sacrifice with the heart of the order, squeeze or dfo any of the things that successful teams do when they must. Same old same old.
