Jack Smith's fuller 2020 election case against Trump is publicly released

AKA, all the crimes Trump committed that were exclusively PRIVATE ACTIONS functioning as a CANDIDATE.

Special counsel Jack Smith outlined the "increasingly desperate" efforts by former President Trump and his allies to try to subvert the 2020 presidential election results in a lengthy motion unsealed by a judge on Wednesday.

Why it matters: Trump and his legal team had opposed the motion, arguing it would interfere with the November election results. The filing unveils new details in connection to the former president's federal 2020 election case.

  • U.S. District Court Judge Tanya Chutkan unsealed the redacted motion on Wednesday.

State of play: Smith in the motion wrote that Trump's "scheme was a private criminal effort." He emphasized throughout the document that the former president was acting in his capacity as a candidate, not a president.

  • This is an apparent attempt by Smith to respond to the bombshell Supreme Court ruling earlier this year that said that presidents have immunity for "official acts."
  • "At its core, the defendant's scheme was a private one; he extensively used private actors and his Campaign infrastructure to attempt to overturn the election results and operated in a private capacity as a candidate for office," Smith wrote.

Zoom in: Smith also accused Trump of knowing "his fraud claims were false because he continued to make those claims even after his close advisors—acting not in an official capacity but in a private or campaign-related capacity—told him they were not true."

  • "At one point long after the defendant had begun spreading false fraud claims, a White House staffer traveling with [Trump], overheard him tell family members that 'it doesn't matter if you won or lost the election. You still have to fight like hell,'" Smith wrote.
  • Smith also outlined numerous instances of Trump's former Vice President Mike Pence telling Trump that there was no evidence of fraud.

The special counsel wrote that "when all else had failed" for the former president in his bid to cling to power, he "directed an angry crowd of supporters to the United States Capitol to obstruct the congressional certification."

 

What they're saying: Trump campaign spokesperson Steven Cheung said in a statement that the filing is "falsehood-ridden" and "Unconstitutional," again calling it an attempt to interfere with the November election.

Zoom out: Smith filed the sealed legal brief last week, leaving Chutkan to decide whether or not to publicly release it, or a redacted version of it.

  • Prosecutors had said the brief contains previously unseen evidence.
  • Trump's legal team argued in their own filing Tuesday that more redactions should be made if the brief was to be made public. They also objected to the release timing as early voting has already begun.
  • Prosecutors responded Tuesday, saying they have "no role or interest in partisan politics."

He is not charged with insurrection due to the politically charged nature of that violation. AKA very difficult to prove.

Like most mob bosses, he never got his hands dirty; just incited his stupid henchmen to carry out the crimes.

And now he's proving they did exactly what he wanted by promising them pardons.

What allegations? They are saying that an aide gave instructions for riots but not trump. We've known about the rest of the nonsense for quite some time.

I think some of trump's actions were seriously wrong if not actually illegal per se already. But if they're not actually illegal then they must be tolerated even if we don't like them.

He's claiming it was an "official act".

Donald hatched and implemented a plan to install fake electors in multiple states.  He then coerced his vice president to break his oath of office and certify those fake electors,  or, at the least, refuse to certify the election. 

If Pence had complied, millions of voters would of been disenfranchised and Donald would of retained power through fraud.

Thus, Donald is a dirty piece of shit traitor and attempted usurper.

The facts are this guy is trying to interfere in an election utilizing tax payer money to campaign on behalf of Kamala Harris. 

It's a distraction from the disastrous debate performance last night where the Democrats have chosen a knucklehead who sweats perfusely when in high pressure situations. Tampon would be a disaster in the same room as Putin or Iran's leaders. 

What a disgrace. Trampling the basic of human rights by promoting sham investigations into Trump

Donald hatched and implemented a plan to install fake electors in multiple states.  He then coerced his vice president to break his oath of office and certify those fake electors,  or, at the least, refuse to certify the election.

There is overwhelming evidence Trump's campaign deliberately ginned up riots to exploit the chaos to overturn the election. Your lack of concern is a reflection of your poor character.

What is damning about this? It proves the Biden administration is using banana republic style tactics.

So the quote that "damns" Trump was made by a guy that wasn't talking to Trump about polling places not in DC and was made in the context of finding legal reasons to litigate the results. It is the most undamning quote ever made.
