Georgia’s top court puts Kemp-backed law to punish ‘rogue’ prosecutors on hold

The Georgia Supreme Court said Wednesday that it won’t approve rules and regulations for a new state commission empowered to sanction prosecutors, effectively rendering moot a law backed by Gov. Brian Kemp and other top Republicans until lawmakers overhaul the measure.

The six-page ruling said the state’s top court had “grave doubts” about whether it had the constitutional authority to approve of the rules set forth by the Prosecuting Attorneys Qualifications Commission, a step required by the law.

“Because we are under no legal directive to take action, the most prudent course for us is to decline to take action without conclusively deciding any constitutional question,” the order states.

That puts the law on hold. While the commission began accepting complaints earlier this year, under Senate Bill 92 it can’t take any action until the Georgia Supreme Court approves a set of rules and code of conduct.

The battle over the commission is being closely watched partly because Donald Trump’s allies aim to use the new law to punish Fulton County District Attorney Fani Willis for seeking election interference charges against the former president.

The order dealt a blow to Kemp and other Republicans who championed the law earlier this year as a way to punish “rogue” prosecutors over the objections of Democrats who say it flouts the will of voters.

Georgia prosecutors predict jail sentences in Trump 2020 election case

Wrote Fulton County district attorney Fani Willis:  We have a long road ahead. Long after these folks are in jail, we will still be practicing law.

The previously unreported emails, between Willis and defense lawyers, open a window on to the endgame envisioned by prosecutors on her team – which could inform legal strategies ahead of a potential trial next year, such as approaches toward plea deal negotiations. 

Still at work and doubling down.

He wasn't asking him to dig up dirt the dirt was already dug up, he asked the leader to get to the bottom of it.

Donald's exact words were "look Into" Biden and his son. So, the potus asked a foreign leader to dig up dirt on a political rival. Whichever way you look at it, that's unethical.

Trump to Zelenskyy: “The other thing, There’s a lot of talk about Biden’s son, that Biden stopped the prosecution and a lot of people want to find out about that so whatever you can do with the Attorney General would be great. Biden went around bragging that he stopped the prosecution so if you can look into it...”

That incorrect. What Trumpco explicitly asked Zelensky to do was to publicly announce an investigation of the Bidens. That's why it was an illegal quid pro quo. If Zelensky would publicly cast shade on the Bidens, then Trump would release the already-approved military aid and set up and oval office visit. Trump didn't need Zelensky to actually find anything. He just needed the campaign fodder.
