Why are you weirdly hung up on this. It's entirely irrelevant. It doesn't figure into the chain of events in any way shape or form.

He didn't pull it out. He didn't use it. Nobody had any knowledge of it until they took him down, beat him and removed it. You know, just before they executed him. 

What if he had a condom in his wallet? What would that mean? Why????? You can be curious all you like, but it's just idle speculation.

Well, yeah, it does. His choosing to go armed to a protest where he was planning to obstruct, did obstruct, and had also previously scuffled with LEO before is almost certainly why he is dead now because he fought with LEO again with a gun they shot him because of that… right or wrong, his stupidity got him killed.

(a) In General.—Whoever—
(1) forcibly assaults, resists, opposes, impedes, intimidates, or interferes with any person designated in section 1114 of this title while engaged in or on account of the performance of official duties; or
(2) forcibly assaults or intimidates any person who formerly served as a person designated in section 1114 on account of the performance of official duties during such person’s term of service,
shall, where the acts in violation of this section constitute only simple assault, be fined under this title or imprisoned not more than one year, or both, and where such acts involve physical contact with the victim of that assault or the intent to commit another felony, be fined under this title or imprisoned not more than 8 years, or both.
(b) Enhanced Penalty.—
Whoever, in the commission of any acts described in subsection (a), uses a deadly or dangerous weapon (including a weapon intended to cause death or danger but that fails to do so by reason of a defective component) or inflicts bodily injury, shall be fined under this title or imprisoned not more than 20 years, or both.
(c) Extraterritorial Jurisdiction.—
There is extraterritorial jurisdiction over the conduct prohibited by this section.

Just for discussion.

Pretti violated this section. The fact that he had a gun might have upped his charges.

 

But what should be discussed is the failure of the first set of agents to detain and charge Pretti the first time (that we know of) he attacked agents. Had they arrested and charged him, he would have lost his gun and he almost certainly wouldn't have died. 

And that is why you enforce the laws. Even the small ones. It is called the Broken Windows Theory. If you stop criminals at the point they start committing crime, you have a greater chance lf breaking the cycle. If the cycle is not broken, at least there is documentation of the escalation for the judge to consider when assigning sentences. Either they reform or they go away. In both cases, the public is well served. 

When Pretti was allowed to go free, it set off a short series of events that led to his death. The best thing to do, right now, is to arrest all these blue terrorists that are obstructing federal officials in the lawful execution  of their duties. Give them their ticket, document their spiral and break the cycle or put them away. Either way, society wins.

Don't you think that if I were wrong that I would know it?
