Unless the criminal is literally tortured or something, I think anything that happens to a criminal in your home is fair game, including murder if its in self-defense or a fear response.

Um... not a lot of details here, but the facts I am seeing are that this was an ARMED intruder in the home, being charged with possession of a weapon for "dangerous purposes"

So, I am left wondering how the homeowner is getting charged here. 

I am hoping this is one of those things where the justice system files initial charges just as a matter of process and as the facts work themselves out they get dropped.

No a robber entered someone's home and the homeowner beat the crap out of him (life-threatening injuries).  Apparently they're saying the violence wasn't proportional to the threat, which is weaksauce by the cops unless he like wailed on him for a while he was already unconscious or something.

Ontario is very bad for this.  They're big believers in "punishment by process". They frequently charge people in these cases and put them through the wringer knowing they'll probably win in the end but they'll be broke and their lives shattered as a warning to others.  There's many stories like this in bc with no charges or charges dropped right away in contrast ,

The thing is it's hard to say without details but you CAN actually run foul of the laws here very quickly defending yourself/ If the guy has a weapon but turns and runs away and you pursue and shoot as he's leaving you're in trouble.  If you shot and he went down and you 'finish' him, it's murder. Even saying 'he attacked so i killed him' is very bad, you should say 'he attacked so i shot to stop him". 

Without more details it's impossible to say but ontario generally speaking is not where you want to be defending yourself out of any of the provinces.

I don’t believe execution is allowed however. If you incapacitate the offender and finish him off at point plank to the head with bullet hole in the floor board for example, that would be considered man slaughter at the minimum or murder.

We don’t know the facts but the police stated the homeowner went well beyond what could justifiably be called self defence to the point that the intruder was left in life threatening condition. For example you can’t tie up an intruder and then decide to beat his head in with a baseball bat. 

But we will have to see what  facts come out of the court case
