Don't get me wrong - I don't like unions.  I think they do more harm than good. 

It's the way Sears rips off people with their pensions - imagine losing their pensions - something that they hoped would be there upon retirement.  If they have millions to reward failures of top executives, then they ought to have the pensions for employees.  Negotiations with unions had long been gone.  Sears should've fought it out with the union then.

(I don't think Sears employees are union anyway.  This may be legal in Canada, but it's really stupid.)

Pensions go to the back of the line when it comes to claims to company assets during a bankruptcy. I don't know what kind of pension plan they had, how much the employees contributed, or how it was managed. Since the market recovery many plans that were underwater after the 08 collapse are now fully funded again, which means the employee contributions are covering all of the benefits and the companies are paying nothing.
