It isn't the autopen itself that is the problem. It is settled law that electronic signatures are acceptable. (Although the executive orders have a similar weight to laws and laws must be signed by the President. The SCOTUS might state that EOs must be hand signed) The caveat is that the person using the electronic signature must consent.
