But no it is not even a little bit illegal to 'bribe people' for their silence and claiming it as a business expense is also not illegal. Clinton did the same thing for example.

However - what is being claimed is that the hush money was paid out BECAUSE OF THE ELECTION - and that's where you run into a problem.

If you spend money for election purposes, be it advertising or paying someone to keep a story quiet and THEN HIDE that expense... you've got a problem. You spent money to influence an election and didn't report it.

Now trump will presumably argue he would have spent the money election or not - he wanted the story shut down for all kinds of reasons, not just the election. Didn't want to put the wife through the pain of it, etc etc.  In which case it wasn't election spending.

The prosecution will try to argue that based on the timing etc etc and what he told other people at the time it was all about the election.

But no - it's not illegal to pay someone to shut up or include it in your business expenses if it could have hurt your business.
