  3. Yes, he circumvented the courts by using the notwithstanding clause. I agree that it is constitutional but it allows him to bypass the legal process.

  5. I don't have a big problem with judges asking for more information in a judge only trial but I don't know that you could reconcile this in a jury trial.

  12. Politicians wrote the the Charter so why blame judges for its deficiencies. They can only work with what they are given. Heaven forbid we rely on the court of public opinion to defend individual rights. That is nothing more than mob rule.
  13. Which Constitution? There is only one public system in BC. Religious schools get the same funding, subject to the same rules as any other private school.
  14. BC has pretty much rejected the ward system and gone with councillors at large. I have mixed feelings about it. Money is more of a factor during at large campaigns and voters basically have to rank their ballots. On the other hand, it discourages Balkanization because all the councillors are responsible for all of the city, rather than just their piece of it.

  21. So Chretien believed that he should have been supreme when he was PM. Politicians don't reign according to their "so called philosophy"? Judges are appointed by politicians after all. I don't think there is a perfect system but history has shown us that there are times when citizens need protection from the actions of their elected governments. Who is to provide that protection if not the courts?

  25. The courts have to rule according to the Charter, even if individual judges don't personally agree with what it says. It seems that any judge you disagree with is an activist. Maybe the problem is yours.
