Army Guy Posted July 15, 2025 Report Posted July 15, 2025 Here is an example of where our justice system fails Canadians, he has been caught 5 times for DUI, has a lifetime ban on driving...this time he puts a young person in the hospital with serious injuries and is released the next morning....i mean WTF....he is being charged for DUI....for the 5 th time, he was charged with driving a car when banned...and the justice system grants him bail the next morning....If the judge could not see that this individual is a danger to himself and others, perhaps he should be asked to step down, and this guy locked up, have his car sold at auction...we need to do better... Father demands bail reform after son critically injured by repeat impaired driver | Watch The family of that victim is going through pure hell right now while the perpetrator was freed to inflict himself on others. You'd think that this accident would have been the straw that broke the camel's back, but somehow it's gonna take more than just "putting a kid into a coma for weeks, possibly months, or maybe even outright killing him" for a perp to be held in custody for real. Honest to God, the guy has multiple lifetime driving bans already, so he was released on bail with the condition that "he won't drive" 😂 If I was a Nigerian scammer I would definitely give that judge a call. There's about a 99% chance that you could suck him in, even if he has already fallen victim to that scam within the last month. herbie Posted July 15, 2025 Report Posted July 15, 2025 Went to court with a friend in the 1970s, his 6th DUI. They read out a history of his previous charges and the Judge asked him if he had anything to say. He replied the prosecutor was incorrect he hadn't been charged 3 times for underage drinking, it was FIVE times. Judge did a Capt Picard facepalm, slammed the gavel and said real loud: I see sending you to jail is not going to make you any smarter. $2500 fine and 10 year suspension. The courtroom burst out laughing. Fortunately my friend listened and did not drive again, he also lost his driver job at the time and thanks to the union had to work out his 30 more years til retirement as a swamper. I also have one up here that is just like the guy in the story. 62 and no licence (multiple driving without) and still rides into town with his wife and while she's housekeeping takes her car to the Beer Store and sits outside in it waiting for her to finish. And gets her to drive back to the beer store on the way home. Last time he got nailed, it wasn't his fault. It was the stoopid cops putting a roadblock up just to harass drivers and collect money for the gummint. He has to drive, goodie jerks like me won't drive him unless he tosses his beer and puts on his seatbelt. I tend to agree with that Judge. Locking them up doesn't make them smarter and only takes them off the road for a little while. I think taking their car away seems to work a little better and short of chopping their hands off or forcing automakers to put alcohol & drug sensors in every car sold. I can't see a better one. herbie Posted July 15, 2025 Report Posted July 15, 2025 (edited) BTW that 10 year suspension and fine would be $25,000 today. THAT might do it. $5,000 on the 1st offence then square it like they used to do with your points. 5000 - 25000 - 125000 - 625000 lose your damn house downtown and explain that to the family.... Aristides Posted July 16, 2025 Report Posted July 16, 2025 (edited) Bill C-75. Trudeau's gift to criminals and poke in the eye to victims. Quote Since the federal government sets the rules, the new legislation told judges dealing with bail applications that they needed to make sure that anyone accused of a crime was released “at the earliest reasonable opportunity and on the least onerous conditions.” Some judges and justices of the peace, who operate in provincial systems, feel that has put shackles on them and resulted in an increase in releases even by violent offenders. herbie Posted July 16, 2025 Report Posted July 16, 2025 Yes, those laws were in response to Court decisions one of which was you can't deny bail unless there's reasonable grounds. The Judges on the front lines seem to be going to extreme lengths to abide by it, even in light of the repeated requests of both federal and provincial govt. And the public perception that they, Joe Blow are more qualified than an actual Judge. EG a guy, first time offender is convicted of domestic abuse. Does he get to go home until his sentencing like a drunk driver or a drug trafficker, a guy who got in a bar fight or an embezzler? Or does he stay in custody like a murderer or a suspected lunatic that ran amok with a machete? I regard a Judge letting one of the latte out as a failure of justice. Or in the Kelowna case when the guy immediately ran out and killed his wife not, as that was entirely unpredictable. The whole popular argument is getting bizarre as in all the talk about the Filipino festival killing devolced into the system failed because the guy was allowed to drive a car! I mean on what possible grounds would he be denied? Even if he was, as we see in multiple DUIs how can you prevent someone doing it anyway? And who and how do you tell beforehand when anyone's going to crack and do something bonkers? Quote
