An Iraqi refugee who raped a 10-year-old boy at a swimming pool has had his conviction overturned because a court didn't prove he realised the boy was saying no.

The rapist, identified as Amir A, 20, violently sexually assaulted the boy in the changing room of Theresienbad pool in Austria claiming it was a 'sexual emergency' because he had not had sex for four months. 

But an appeal court in the country accepted the defence lawyer's claim that the lower court had not done enough to prove he knew the schoolboy was saying no and overturned the conviction.

 

While I have not read the court file, it seems that we, in the West have lost the ability to say that any conduct at all is uncivilized. What happened to the little boy's rights? He is now suffereing PTSD. Are we so attuned to the rights of an 8th Century people that we ignore our own rights?

No of course not. Why read the court file when all types of things can be stated without a factual basis so you can set up whatever point you want to make.

We have all seen court cases in various jurisdictions make strange and even bad decisions - especially when it comes to rape. 

I would not have to look far to find many in Canada and the US where the rapist got off with hardly any form of punishment. 

 The point is this: if you want to discuss such things then shouldn't they be based on facts?

if so, then wouldn't the best thing to do be to find the related court documents and provide a link to them so we all have a chance to access the facts even if we don't read the language? 

Is that too much to ask?

Now with this preamble out of the way, let the straw man arguments begin and I take my leave....

Can you translate from the German?

More to the point why do so many assume that any time an act of savagery occurred it is justified and the civilized world has no right to push back?

He did not get off, he is still in custody awaiting a retrial.  In my opinion the original sentence of 6 years was too short, consent or not. I don't know the law in Austria, but in Canada a child of 10 can't give consent.

Welcome to the new world order. But really doesn't this rapist have rights too? Besides very soon pedophilia will become legal all over the world in the next decade or maybe sooner. Then those pedophile child rapists are going to have a field day and there is nothing you will be able to do about it. Accept what is coming because the will of the liberal elite will not be denied. Aw well.

That consent in Canada may change one day soon as we all must know by now that Canada does not discriminate against peoples rights and beliefs. Once pedophilia becomes legal in Canada, and it will, well we ain't see nothing yet. It will then be open season on our children by these perverts. After all homosexuality was allowed out of the closet.

Nope, not good. We are just beginning to see Sodom and Gomorrah come back to life after homosexuality closet doors were opened wide. In the future we will see pedophilia,incest and beastiality leave the closet also. It may not happen tomorrow but it will happen because the pathetic elite liberal establishment always will get their way, and they will get their way. Just watch and see.
