Ah, no, apparently you missed the point, again. It's about police action at a routine traffic stop.

Why do you continue to ignore what is so completely obvious. The cop over stepped his authority, impinged on a person's rights, and escalated a situation completely out of control. And you choose to dither over a freekin cigarette.

How realistic is that? Give your head a shake. That attitude excuses the cop who either wasn't very well trained, or ignored his training and then their is the race issue. She made a illegal lane change. Big deal! A ticket and on her way is how it should have been handled.

I agree. And a ticket and on her way is all it would've been if she just put the cigarette out. You gotta pick your battles. It's like when I'm coming back from Michigan and I get some a-hole customs agent. I can comply with his rudeness and time wasting suggestions, or I could confront the rudeness and risk him pulling me aside and totally searching my car for no reason.

Yet again, you are failing to place the blame where it belongs. The cigarette is a non issue. If you pay attention to the video you can tell he was going to escalate things for whatever reason he could find. Aparently he is rookie and hopefully taken out of service. Perhaps the whole PD needs to have a rvue of it's training.

No I blame the cop. But understanding risk/reward and de-escalating a situation with somebody who's clearly abusing their power is more important. Then you'll always have legal recourse afterwards to help remedy the situation.

Right...if it was that easy to dodge the cops...we would all do it.

"I am not going to listen to you officer because I think you are poorly trained and not being very professional...so there !"

Economics trumps Virtue.

And what legal recourse could she possibly have access to in this case? Explain how that would work, and who would bear the cost?

If she feels like her rights were infringed upon. Some people might feel however that a request to put out a cigarette falls short of that, and might even be somewhat reasonable. How would it work? The same way any lawsuit is filed against an officer or police department. She might have to bear the cost, or she might find a lawyer through legal aid or even willing to take the case pro bono.

Yep. It's all part of the new "arrest is optional" mantra. Um, no it isn't. It's not a debate club. If you're placed under arrest, you don't have a choice. The choice and recourse comes afterwards.

Note the actions of this very patient constable dealing with a smart ass perp....he asks that the cigarette be put out. It is always interesting when Canadians demand that they be Mirandized...something that applies in the U.S.

That's a whole lot of "mights". Fact of the matter is this woman failed to signal a lane change on her way to start a new job, probably a hundred buck ticket or some such. Because of an apparently poorly trained, over zealous, possibly racist cop, she was led off in handcuffs, sent to jail, and is now dead. She MIGHT have just paid the damn ticket, and gone on to a successful career.

I don't know if the cop is racist etc. But clearly abusing his power. Put the cigarette out and/or challenge the arrest in court.

If you watch the whole dashcam video you see a previous traffic stop the sa cop makes where he is completely polite and gives only a written warning, no fine. No get out of the car, no put out your smoke. What you can't see is the color of the lady in the first stop, only voices. Any bets as to the color of the first one?

She was arrested for disobeying a lawful police order to exit her vehicle and for allegedly assaulting the police office.

He has no right to arrest her...but he does have the lawful authority to arrest her, and he did.

Economics trumps Virtue.
