For real, how was this not challenged in court until now?

I'm really suprised. Is sexual orientation not protected in human rights laws in canada?

I can understand calling it a crime, but mental illness?

What does this say about diagnostic psychiatry these days.

This as prostitution becomes legal.. they drop covering treatment fees...

is this a protection against the US military soilders due to be stationed in Alberta in a couple months? How long do you need to reside or have a place of occupation in alberta before eligible?

Does this mean up until tuesday I could get vixin hookers in Alberta if I said I was gay?

Probably because it wasn't widely known. Anyways, who really cares? Correct it and move. Not everything has to be a big deal.

It was widely known enough that

doctors used the diagnostic code to bill the province for treating gays and lesbians more than 1,750 times between 1995 and 2004,

"Sexual orientation" was dropped from the original draft of the Charter of Rights and Freedoms for political expediency. Subsequent "Charter Politics" court rulings have since included this as a protected class.

That's right - section 15(1)

Subsequent "Charter Politics" court rulings have since included this as a protected class.

Well, I don't see how 15(1), which grants equal rights, gets homosexuals anything but equality; which ain't so special or "protected." I guess being "protected" from inequality is special - I dunno.

But section 15(2) could get them to be a "protected class" I suppose.

I was referring specifically to the subsequent SCC and other court rulings that "found" such protections based on the Charter's interpreted framework, even when no such protections were enumerated and were specifically dropped from the original draft language.

And I was agreeing with you....

Well, you're becoming more Canadianized hanging out on these forums. ;)
