It's highly convenient, to be sure.

Otherwise, how are you going to prosecutue child soldiers?

I suppose if child soldiers are issued uniforms (since they have no choice either way), they can still do what they do and then receive better treatment from us.

You're right of course, this quibbling is especially heinous not ridiculous.

Yep. We're being told that Khadr is open season because the 15-year-old didn't go find a uniform somewhere.

I think we are being told that it's open season on Mr.Khadr because he left this country to fight for the ideals of the Islamofascists in Afghanistan...In essence, that is treason...

He's not being tried for treason.

His child-soldier status, on the other hand, has been ignored roundly.

I agree the child soldier issue is not being adressed...

He should be tried for treason because a traitor is precisely what he is....

Another interesting development about the issue of uniforms and "unlawful combatants; buried in this CNN piece is a remarkable situation:

In another development, Colonel W said a CIA officer who wore civilian clothes and had sometimes been armed had accompanied American and Afghanistan soldiers on the attack.

Is this officer an "unlawful combatant"?

"a trained killer" So a thousand Canadian troops and ten thousand American highly trained troops are NOT trained killers?

TREASON! Mayor miller insists that we ride bikes to green the city...Yet when my son was struck down by a wealthy Asian career woman...the cop was bribed and the prosecutor and her defence lawyer..Tossed the case aside as if my son was a person of no value?...............I would say that most of those in positions of authority in Canada and America - offer no civil rights to the common person - SO I SAY THEY ARE ALL GUILTY OF TREASON!

This little hate object that they have found in Khadr...is so much hetrophagism. Those weasils amongst us that attack the boy in Khadr -----------are not men...just worms/

Not sure if a 'treason' charge would stick.

After all, the definition of treason is that it involves situation where an individual takes action against his own country. Khadr wasn't (to the best of my knowledge) fighting Canadian soldiers, he was fighting Americans. (At best you could say he was battling against the ideals of Canada, but I don't think that in itself.)

I'm not certain of that...

When one ties in the Al Quaeda family angle, and the quotes from his mother about this country and the West,it seems he was taught to have a visceral hatred for the society he was brought up in...

It's a tough one,but it sounds like treason to me...

Khadr is a perfect example of why Western soldiers need to shoot their enemies to kill on the spot, rather than taking them prisoner. How many millions (both in Canada and the US) have been wasted on this piece of trash terrorist by now?

Yes he was.

The UN says under 15 not 15, and treason would be easy if the law was follwed a attack on one NATO soldier is attack on all NATO soldiers. But I am sure he will be released and then he will get a nice job with the canadian postal service.

Toronto, like a roach motel in the middle of a pretty living room.

That's even more pathetic than quibbling about uniforms. It it meant under 15 it would have said 14. It says when you attain the age of 15 years which of course is the day before your 16th birthday.

But I am sure he will be released and then he will get a nice job with the canadian postal service.

I'm hoping he gets an official apology and a multi-million dollar settlement.

How about getting the jerks that have weapons contracts..who wage this war for profit and fun....who bullshit the public with "so a little girl can go to school" - mean while there is a tacit policy put forth to our military personal to "turn a blind eye" to the entertainment through buggering and destroying small male children?

As for guys like Cheney and Bush who launched the Nazi like invasion of Iraq and now Obama with his big surge bull shit....mean while the oil people in Saudi Arabia..who financed the 9 11 operatives and who were Saudi Muslim henchmen for the bored Saudi elite - who are in bed with western oil men...YES this Khadr thing is diversional - no one wants to face the fact that OUR big business guys betrayed their own nation and people for profit and intrigue ...

Also what about those wide eyed white Christian boys from hicksville who are "sacraficed" uselessly fighting an enemy that does not even know or care where Toronto is let alone Canada - that is the sin - to lead astray our young marshall class and kill them for nothing other than elitist sport....

Khadr is a non-issue - just a hate object to amuse and mobilize the stupid unwashed masses while jerks like BP piss in your food supply and walk free..

No, in order to mean "under 15" it says "under 15".

It's amazing how you'll complain about those who quibble using definitions while you quibble about the definitions themselves. Which way would you like it?

I like the way they kept him confined until he was old and bearded and scarey looking - Like Harper said "Mr Khadr has been accuse of some very serious crimes" - the weasils all waited until the kid was older...It would have made Bush Cheney and Harper look like cowards if they cruxified a 15 year old - so the cowards waited until he looked like a real bad guy - a terrorist...He was a stupid kid - he has done his time..BUT there is a problem with him being released - He simply knows to much on the sad workings of the military industrial complex and must be kept confined because he might spill the beans on the fact that his captures are all liars and murdering bastards who do not fight terrorism - because they are terrorists ALSO.

The truth hurts - but that is the way I see it - hypocrites - the other day I was in traffic court because my son was knocked down buy some rich ASIAN lady - looks like they bribed the officer not to appear and they discharged this maniac who runs down young men because she is to self involved - when we fix our own corrupt system - then we can be proud that there is justice - My son was worthless to the system and who ever paid more...got human rights - those with no money get nothing - Just like Khadr will get nothing because he can not bribe his way out.

Even from that perspective, I do not think that it can be counted as a complete waste. How this case has been handled has revealed numerous issues with the systems in Canada and the US which would likely have never come to light if he had just been killed.

From a factual standpoint though, Khadr was not a relevant case of " shoot to kill " because he was found alive after the fight. Executing your enemies on the spot is highly illegal in a way killing them in a fight is not.

The same way the UN does, "The United Nations Convention on the Rights of the Child, Article 38, (1989) proclaimed: State parties shall take all feasible measures to ensure that persons who have not attained the age of 15 years do not take a direct part in hostilities."

You attain that age on the day before your 16th birthday, not the day after your 15th.

Uh... eyeball... When you are born, you start at 0. When you reach the age of 1, you have attained a lifespan of 1 year. Ergo, when you reach the age of 15, you have attained a lifespan of 15 years.

My mistake, it actually says attained the age of 18.

"States Parties shall take all feasible measures to ensure that members of their armed forces who have not attained the age of 18 years do not take a direct part in hostilities".[2] Non-state actors and guerrilla forces are forbidden from recruiting anyone under the age of 18 for any purpose.

He was recruited at about the age of 8.

If you want to quibble about what 14 15 or 16 means fly at it.

That clause only marks Khadr as a recruit who should never have been; it doesn't define 18 as the end of childhood. Your argument was that Khadr was a "child soldier".
