Have i been called on it Waldo, i used the word prisoners, what would you have me call them, i use that word because Omar was declared a Illigal combant by a court of law....sorry i just take them prisoner, wrap them up in bubble wrap, until they reach another destination, or high authority....Just so we are clear....the POW status does not apply to terrorist or illigal combatants, it does state in the convention how they should be treated, but it clearly states that they are not afforded any other rights under the convention.....i can produce the convention if you want.... Next the US courts have declared mr Omar a illigal combatant....and in doing so does he does not fit in with the current UN's defination of Child soldier nor is it mentioned in any of the conventions........the UN decided that not me....And as far as i know they have no intention of changing it.....there is no wiggle room just the law, don't like it....get it changed.... Lets talk about ethics shall me, I am a soldier for our nation but also a citizen that have the same rights as you do....as far as i know it is not agains't the law to discuss this on a public forum is it ? As for blaming or designating guilt i don't think so....i have said dozens of times he should have his day in court...and he should be held accountable for his actions....if thats a bad thing your right i should be flogged..... What i have done is present some of the evidence that has already been heard or presented in a US court of law....Again thats not a crime or unethical is it ? I have freely expressed i share no love for Omar and his kind....would you after attending so many comrads being loaded onto herc's.... -
Yes it is considered torture, by alot of organizations, the same that describes listening to loud annoying music torture, or leaving the lights on, or depriving someone of sleep for long periods of time, and placing a person in a stress postion..... kind of like the rack, being pulled apart by horses....or guted with a hook, removing teeth, finger nails, limbs....smashing limbs and digets a hammer.....ya the other stuff sounds like child play

I want to clarify this right now, Canadian soldiers are very carefull to stay within the ROE, and don't just wantonly open fire on crowds or take retribution on Civilians....And to date there has not been a problem that i'm aware of... I'm not suggesting anything of the sort, i have in past posts agreed fully that all prisoners should be treated as per the genva convention..... I just find it ironic that our ROE's which are based under Canadian laws, inter national laws, and all the conventions, allow or have found guilty mr Omar enough so that deadly force could be used..... And i do understand the difference between Battle field conditions and inside a court house conditions....and yet both are governered by the same laws....just different process....this has been one of my pionts....you can't take a combantant off a live battle field and expect there be enough edvidence to convict him in a court house.....so your right in these circumstance our laws need to be changed....or modified....somewhat atleast meet in the middle some where...as i doubt any forensic guys want to travel to the battle field site to collect evidence after every battle for every prisoner taken, every bad guy killed....but i don't see any other way if we are going to continue to charge combatants in a civil court of law... Your right there is no love lost between me and Mr Omar, it's not that i despise him, but rather what he stands for , and what he does for a living... If there is no cash to be made by holding prisoners then the taliban execute them, normally down with a dull knife and sawing the head off....but no where in my post have i said we should be as brutal, no where have i agreed on the mistreatment of prisoners, infact i wanted him to either face justice in Afghan or come home to face our courts.... As for the Airbourne guys , what they did was wrong, what the government did was wrong and what the Canadian people allowed the Regt to go thru is wrong.....but thats another story. Touche....yes we have charged and found guilty ...thousands of guilty bastards....and yet we also allow to run our streets and neiborhoods dozens of known terrorists, Khadr older brother, his other brother which is on the CIA payroll or was...all have supported , gather funds , or assisted terrorist activities....they've even admitted as much but either there is no edvidence or we failed to prosecute.... Thats to bad, as i've said at the begining of this whole Khadr thing it was my personal feelings that any or all charges will be droped and he will be welcomed with open arms back into Canada....justice is not served....much like the OJ case we know he done it just could not prove it.... Which sends what message to the world.....we are fair and just...or we could not find justice with both hands in the daylight.....and all terrorist are welcome.... First you have to issue them right....much like on of the leading characters in the Rwanda geniocide, living here in toronto....for how many years....i know there is problems every where....but come on....I will agree with you a Military commision is not the way to go....only because DND is not set up for this type of high profile trail....but then again nither is our civil courts....i think we are setting our selfs up for failure....and sending the wrong signals to the world....maybe the only answer is sending him to Afghan ... -

Actually the laws within Canada are for all ages, and anyone can be charged, it is the sentencing and imprisonment that changes....i guess the ball is back in your court..... -

I would tend to agree with you, i think he should face up to his crimes where they where commited like any other Canadian is or has....however i think a growing majority does not want anything bad to happen to this boy....But they have yet to say what the real reason is that this boy deserves to be treated differently. -

Perhaps we should ask those questions to the very young men and women that we will be asking to risk thier lifes for our little fight....I mean why get into a fight if your not going to win...or do what it takes to win....Those that think that the battle field is some arena where there is ref's and linesmen....there is not....War is a serious business and it is not won unless a nation is willing to do what it takes to do so.....and if it is not then it should consider not getting involved.... -

Dub: I wish that statement were true, but most of the time it comes down to us grunts getting off the bus and closing with and destroying the bad guys, with nothing more than my rifle and my trigger finger.... As for tying our hands behind our backs....ever been on the modern battle field....or are you one of those arm chair commando's you think they know what it is like to take a life, or engage an enemy that follows no rules, which is acceptable to Canadians ....but holy shit i even bruise a prisoner, and i go in front of a board of inquiry.....people back home scream Abuse....get the rope.... Maybe thats the problem, it always been our soldiers that pay the cost, maybe after this war touches you personally your attitude will change.....and you'll be screaming another tune.... -

Yes Capital punshiment has been outlawed, with the military finally removing it from it's list of punshiments, however there still remains the precedent that a Canadian was charged with treason outside of Canada.... -

Here is a couple of major problems i have with this whole case.... 1 ST If Omar had been killed that day, do any of you think the rest of Canada would have heard about it....and what would Canadains think of that situation....it'as OK to kill him on the battle field but not subject him to gitmo....ironic.... 2 And According to our Nations ROE, Omar's entire group of buddies Omar included where guilty enough to kill on the battle field ....And yet once captured we can not find it in our hearts, or our laws to have him charged....or make a charge stick.....Is there something wrong here....I could have killed the boy with no greif or investagation if i remained within the ROE set out by our nation....But our Nations laws can not make the same charges stick in a court of law..... It is true our country should have grabed this by the balls years ago....and lead the pact....however, only if it is willing to have justice served, and our nation must be willing to make a world statement that terrorism is not tolerated in Canada....And Omar is not the only terrorist living in Canada....there is a shit load as we are a heavan for them with our soft laws and regualtions.... -

Does it not show him and his buddies planting mines ? does it not show him handling mines and explosive material, does he not brag about wanting to kill many American soldiers,....add the confessions of US soldiers and you might get a clear picture.... Actually the Canadian government along with the Afghan governmet make the laws, and while in Afghan NATO assist in enforceing them.... in order to enforce them you must know them....But hey don't take my word for it....research it...Murder, terrorist activities, bomb making.... A court of law determines guilt nothing more... I guess your right there is no terrorists in Canada, because of some mix up in the wording of one terrorist..... I guess i must be one of those.....Are you saying it is impossiable to be charged with treason outside of Canada....if you are show me a link.... It clearly says at the bottom of the art that it is illigal to do any of the examples they mention outside of Canada..... Bullshit, now who is making stuff up..... Oh the horror, had he found another ocupation perhaps his freinds may be alive.....they had no problems gunning down 3 Afghan soldiers, had no problems engaging US troops, with rifle fire and grenades....and we are supposed to say so what, lets forget about all that over a few beers.... If they fall within the ROE, then yes deadly force is authorized by our government...It is not uncommon in Afghan to have armed taliban insurgents at the age of 10 and up....that would not hesitate to put a round in a NATO soldier...On the battle field average confrontation is between 2 and 300 meters hard to tell exactly what age they are at that distance.... -

It's not that i have avoided it , in fact i've mentioned serveral times....but since we are here lets discuss it....one of my main pionts is Why is it that we have here in Canada charged young offenders with adult crimes and why have they recieved adult sentences....IE once they become adults they are transfered into the Adult system....And if we as Canadians have accepted this Practice as some what normal why can it not apply here.... Second Omar does not fit into the child soldier convention as it has been written ....as it does not or has not included acts of terrorism, or terrorist activites....nither has the genva conventions been amended to include any of these acts...other than saying that terrorist prisoners are not accorded any protection under the treaties, and that they shall be treated Humanely.... What i find very frustrating is that if this case is made into precedence it will give any child a free pass regardless of the crimes committed within a war zone....but not on within our city blocks... and yet on the battle field it is OK and acceptable to kill them at will....until we capture them and detain them then we have to watch how we treat them, house them etc etc... -

Give us all a break, i think alot of things are unfair...but i don't use terror as a wpn to prove my case....Unfair my ass....I think paying almost a buck a liter for gas is unfair, but i hav'nt suicide bombed any middle eastern oil producing country, i think thier human rights records are unfair, but i don't drive a plane into any buildings, i think harbouring these scumbags within our own country is unfair, but i don't hunt them down like dogs they are on Canadian streets...Unfair....holy shit Bin Ladin is another nut case with his tin fiol hat on to tight....it was Middle eastern oil purchased by western states that gave Bin Laden his nice comfortable life....Middle eastern oil belongs to the highest bidder along with anything else in that country.....including bin laden....
