Title 9's protections are based on sex discrimination and this is going to redefine "sex" to include transgender (gender identity) students identifying as a sex they are not. It doesn't have to explicitly spell out sports... when a school forbids a trans student who is a biological male claiming to be a female from competing... that defacto becomes a discrimination based on... sex. The Biden admin pulled out the explicit language on sports in a political maneuver, but it doesn't change what the foundation does here in changing sex to mean gender identity too AND if this does go through as OK, then that is the next logical step to explicitly spell it out.
