NY appeals court voids the nearly $500 million civil fraud penalty against Trump

A New York appeals court has thrown out the nearly half-billion dollar judgment against President Donald Trump in the civil fraud case brought by the state’s attorney general.

Thursday’s decision, which was not unanimous, leaves Trump still liable for fraud. The judges aligned to uphold his liability and toss the penalty so the case could move forward for further appellate review.

In the prevailing opinion, the judges wrote, “While the injunctive relief ordered by the court is well crafted to curb defendants’ business culture, the court’s disgorgement order, which directs that defendants pay nearly half a billion dollars to the State of New York, is an excessive fine that violates the Eighth Amendment of the United States Constitution.”

The Biden era Banana Republic has fallen and his illegal acts are now being voided.

Don't you think that if I were wrong that I would know it?

This was always going to be the outcome. That whole trial was a joke. Next up, Trump's felony convictions will get tossed, and Leticia James will be in court for her Mortgage fraud.

It’s another illustration of how the justice system was politicized in order to go after Trump.  If the anti Trump people can’t see that by now they never will.

Yeah.  But realistically we knew that.  robosmith didn't, but the rest of us did  :)

But I think that the democrat and democrat supporters knew that it would take at least this long to even begin clearing it up. I mean this is still not isn't over, this is just one step in the process.

And the idea was to try and get something that is discrediting out before the election. How many million times did we see left-wing proponents claim that trump had been guilty of fraud? He was never tried for fraud and civil fraud is not remotely the same thing and a ruling isn't a conviction, but that didn't stop them from running around insisting he'd been convicted of it.

And they wanted to give trump supporters the impression that if you gave trump money all he was doing was paying his legal expenses

Trump voters didn't go for it and I think the democrats are deeply shocked that this kind of banana Republic Showmanship and legal abuse didn't have the intended effect

Oh yeah. 100% this. If you want to start throwing out the terms they throw around, it was election interference.

Getting Trump arrested and convicted of ANYTHING no matter how dumb, was always the goal, to throw enough mud at the wall, to make him look bad, to beat him.

I mean, look at the attempts to remove him from the ballot for "insurrection," man, looking back, they did so much shady, disgusting crap.

Don't worry, your banana republic is alive and well.

You're LYING AGAIN. Only the penalty was voided as "excessive."

what part of this did you not understand?

In any case, if there's no fine then the whole thing is nothing.

But you SWORE up and DOWN at the time that THE fine was ENTIRELY APPROPRIATE and WOUDN"T be thrown out LATER!

And his statement would still be correct. The fine was an illegal act that violated his constitutional rights according to the court. The courts will now discuss the rest of the case, but in fact the Biden era illegal decisions are indeed falling. That is a factual statement

Exactly what it says fool....  They've left him as liable but believe the fine amount is excessive.

The key word is 'liable'.  Something you don't understand about that?

I take it they don't cover this kind of thing in english class till grade 10 these days :)

No, they agreed that the liability still needs to be reviewed along with the rest of the case but that at the very least they could all agree the fine was a violation of his constitutional rights (big shock) and they set that aside so they could go on with the rest of the review :)

again, remember he's not 'guilty' of fraud. civil fraud is not the same as 'fraud'.

So they could easily come back and say there's zero fine, which means no liability.

What we CAN say right now is that the democrat judge violated his constitutional rights with his decision. And the rest is under review.

You have a real problem comprehending.... or is it because you're on the drive thru window break now and can't concentrate?

Why are you a big Trump supporter...  more closely aligned with Poilievre or just another lost sheep looking for someone or something to follow?

Kid you're about as complex to figure out as opening a can of pop :)  Your problem is you're not smart enough to express yourself. Which i find amusing.

Why wouldn't I be able to concentrate at the drive-thru window? Are you saying you have trouble concentrating when you go through a drive-thru window? You find the process so mentally challenging that you really have to focus ?  LOLOL

You REAAAALY suck at this :)

Sigh. see if you can sneak into that grade 10 class early, it's painful watching you.

First off i assume what you mean was something along the lines of "Why are you, a big trump supporter, .." rather than 'why is it that you're a big trump supporter' which is what you actually wrote.

In fact i'm not a big trump supporter and frequently criticize him on this very board :) I think he was a much better choice than Kammy and the dems for the americans but then i'd also think a steamed oyster that had been polluted by red tide would be a better chocie than kammy and the dems.

So right off the bat your question was invalid.

The second part  of your cypher gibberish is a little more challenging. Not sure at all what you were trying to say, seems like you were just having a freak out and crying again.

But with regards to PP it is empirically evident that he has the knowledge of what needs to change in Canada in order to correct the disaster of the lost decade and give kids back their future,  but even more importantly the experience and skills to make that happen.

Carney has neither - he stole PP's ideas and clearly doesn't know how to execute them, and unless PP gives him updates he won't know what to do next.  His housing plan is a failure waiting to happen, he's blown it with the first nations, he's screwed us with china, failed with trump and can't get projects going .

PP will be able to make far more headway on all those fronts.

we TOLD you that justin would be a disaster. Justin was a disaster.  Worst prime minister in history. We're telling you now carney will be a disaster. He might have done better than Trudeau in good times but he is NOT the man we need right now and we're going to pay a horrible price.

So the REAL question is why the hell are you backing CARNEY?

Simply....he's a likeable guy who has forgotten more about economics, business, international trade and how the world works than Poilievre has ever known.  I have a tough time trying to support a career politician with zero practical experience and who's only schtick was/is trying to be a Maple Maga.

That pretty much sums it up....

In fact he appears to have forgotten EVERYTHING about economics, business, international trade and how the world works.

How is that a GOOD thing?

I see ha had another phone call with Trump.  And again the next morning he's reducing tariffs on the usa in exchange for...  absolutely nothing.

Too bad he didn't forget how to get down on his knees and roll over on command.
