Premier says B.C. judges are rejecting prosecutors’ detention requests - demands federal changes to the law

In B.C, Eby said, preliminary data on bail hearings indicates more than half of the attempts by prosecutors to seek detention are being rejected by the courts.

 

“Prosecutors in B.C. only seek detention when they are concerned about the safety of the public, the risk of reoffending and public confidence in the justice system,” Eby said.

"Police and prosecutors in B.C. are doing their part within existing laws to keep people safe. The federal government must act on its promise to amend federal bail laws to address this national risk to public safety showing up in every province and territory.

Meanwhile, Kamloops-Thompson-Cariboo MP Frank Caputo is still hoping his private member’s bill, calling for stricter bail laws on gun crimes, eventually becomes law.

Caputo, the Conservative Party’s associate shadow minister for justice and attorney general and former Kamloops Crown prosecutor, said his bill would see a greater burden placed on repeat offenders to justify why they should be granted bail — known as a reverse onus as that test is usually up to the prosecution.

Caputo has noted Toronto Police statistics showed half of shooting-related homicides in Canada’s largest city in 2022 involved accused people who were on bail when the crimes were committed.

If it were just in one province we could say that perhaps it was something OTHER than his crime policy. But it's not - it's every province that's noticing the uptick and the percentage of crimes being committed by repeat offenders is skyrocketing

Police in vancouver spoke of a case where a man was arrested on a violent crime - released - arrested later, released - arrested later again - ALL IN THE SAME DAY.

I don't care if you're liberal, ndp, conservative of space alien - this is beyond political lines and Trudeau has to take action IMMEDIATLY.  Not 6 months from now, not a year from now - not JUST before an election campaign ... people are dying today.

The bail laws must protect citizens from repeat offenders who pose a threat. It is as simple as that. The recent stabbing of a student in Toronto is a horrible example of how this is not happening. It is terrible to see how the victim's parents are coping with such a senseless act of violence. Over an element that was out on bail. He should have been in prison or hospital. 

It is unacceptable that criminals can roam freely and cause harm, while the government seems to be failing to address this issue. If the government cannot handle this crisis, they should acknowledge it and encourage citizens to take up self-defence measures or hiring bodyguards. Why not? If this keeps up, competition between bodyguard companies will bring fair prices. So, next thing you know, people will go with their bodyguard at work. Some, that have good jobs, 3-4 bodyguards. 

The sad part is not only are they failing in their duty to protect the citizens by locking up the dangerous, the fact is they passed laws putting MORE dangerous people out there. That's why we're seeing the surge.

Criminal law is federal, and Judges are bound to act on federal law and Supreme Court rulings, not on the ldesires of Mayors, Premiers and Provincial prosecutors. RUlings must come from the top... and that's overdue.

Add in the fact you do not hear about rulings that aren't the revolving door as that's the norm and not news. I have noticed in the weekly paper that still does the court reports there's a lot more of the local cases getting time compared to a year ago. But the one that didn't is still headline on Page 1, not buried on Page 16 with the rest.

The scumbag down the street finally had to beat a girl to death to get locked up after years of dealing, assaults, even chasing people down the street with axes and being back there doing it again a day later....

It seems to me like that needs to be the title of their articles on this topic, not a quote buried in the middle paragraphs. 

Everyone cares about gun violence, Trudeau's voters would like to believe that they are the champions of the fight against gun violence. They can't possibly ignore a stat that says "50% of gun violence comes from _________."

And tbh, violence begets more violence, so the 50% of gun violence by these people is probably the root cause of some of the gun violence that happens afterwards. if that's the case then it's 50% plus x percent

In any event, you may have stumbled on something that we can all agree on here ?

Yeah it's not just Toronto. Thanks, Trudeau. Like things weren't bad enough you had to go and make them worse.

Police in Alberta’s capital say 2022 saw the highest number of violent crimes ever reported in a single year.

Edmonton police data shows that 2,880 people were arrested and released in 2017. Of those, 1,784 people, or 60 per cent, were involved in violent crimes again, including three homicides between 2017 and 2019.

After Bill C-75 was passed, at least 3,647 people were arrested and released in 2020 in Edmonton. Of those, 2,482 people, or 68 per cent, were engaged in violent crimes again, with 26 homicides between 2020 and January 2023."

Between January and March of this year, firearm-related crimes jumped 75 per cent compared to the same period last year.

Gee, I thought tightening gun control laws was going to do away with this sort of thing!?

Relax - it's not possilbe they could have used a banned gun so we just have to check the registry for restricteds and we'll find out who did it.

Of course we'll also let them out 10 mins later but still we'll know who it was, so .... closure!
