A 4 to 4 tie means that there is no decision or that the previous decision that sent the issue to the SC stands. In 2014, a lower-court ruling allowed California to compel non-union workers to pay the fees. That was appealed. The SC 4 to 4 tie left the lower court ruling intact. http://www.reuters.com/article/us-usa-court-unions-idUSKCN0WV1PG Scalia was considered the most right winged judge on the court and it was guaranteed that this last decision would have goine 5 to 4 to overturn the lower court decision and weaken the union movement. It is ironic that the Republican leadership refuses to even consider any suggested appointment to the court by Obama. I assume that they want to see if they can get a Republican into the White House and another right winger appointed. The Obama suggested appointment is more central than left. If the Democrats win the White House again they will get a left winger thrust down their throats. Although who knows - maybe President Trump might appoint Sarah Palin.
