pinko Posted March 5, 2011 Report Posted March 5, 2011 (edited) Winnipeg Free Press - PRINT EDITION Rape victim 'inviting,' so no jail Judge rules woman's clothes, conduct ease blame on attacker A convicted rapist will not go to jail because a Manitoba judge says the victim sent signals that "sex was in the air" through her suggestive attire and flirtatious conduct on the night of the attack. Kenneth Rhodes was given a two-year conditional sentence last week which allows him to remain free in the community, in a decision likely to trigger strong debate. The Crown wanted at least three years behind bars. http://www.winnipegfreepress.com/local/rape-victim-inviting-so-no-jail--rape-victim-inviting-so-no-jail-116801578.html This very controversial ruling has brought to light several cases involving this recently appointed Harper nominee to the bench. Some are calling for the judges removal from the bench. When you read this it makes you wonder where this judge has been all this time. Edited March 5, 2011 by pinko Quote

Topaz Posted March 5, 2011 Report Posted March 5, 2011 In our local coffee shop, people were talking about this and someone said, that in a small way the judge was right when he said about the way the woman was dressed. Men, are aroused by vision and this gets a guy going BUT the man had no right to rape the woman either. Today's,some young women seems to want to dress like they have something to sell and to some men this is a tease. So would one say both parties are to blame for what happened. The man should definitely gone to jail and the woman better take care in the way she dresses? What's the answer? Quote

I don't think the way a person dresses should have any bearing whatsoever in considering an assault of this nature. The judge in this case ought to have known the nature of the law and precedent in such circumstances. The Crown should appeal this decision. Quote
Oleg Bach Posted March 5, 2011 Report Posted March 5, 2011 POLICY...NOT JUDGEMENT...and that is a serious problem - we do not have judges that judge between right and wrong...Just some institutional policy that maintains a sick status quo...also - drug testing should be done on our so called judges..perscribed and non-perscribed medications are used by some of these jerks - would be nice to know what they are on before you enter the court room with your aggressive coked up lawyer. The_Squid Posted March 7, 2011 Report Posted March 7, 2011 There has to be an appeal on this. It will be over-turned I'm sure. This dinosaur, right-wing, nutbar of a judge should be fired. So do all women at a nude beach deserve to be raped??? Sheer idiocy. Quote
Mr.Canada Posted March 8, 2011 Report Posted March 8, 2011 This is a brand new judge. What'[s more he didn't even practice criminal law. This ruling shows so much disrespect for the victim it isn't even funny. "Sex was in the air", please tell me that this judge didn't say that. If there is a way to remove a judge from the bench then we should try to do it. Quote "You are scum for insinuating that isn't the case you snake." -William Ashley Canadian Immigration Reform Blog

treehugger Posted March 10, 2011 Report Posted March 10, 2011 Should armed robbers be treated more leniently if their victims are rich? This isn't the first so called judge that has passed these ignorant comments.I guess you don't have to be too smart to have that position. Quote
