Both had already made the ruling , that the military commission was bogus.....what they failed to do was follow up on the ruling and enforce it.....neither of them did any of that...what they did do was no more than offer an opinion ( my opinion)....to the media, ....OMAR served the rest of his sentence 3 years......until released on bail. Yes Canada is being held accountable , but it was not Canada that violated his rights it was a few individuals, that held positions within our governments organization.......that is one problem with this whole issue.....Those that made the decisions are not held responsible..... And while Canada is being held to account for a few wing nuts......we have forgotten Omar and his crimes or charges that could have been levied here in Canada.....That is my point....those are also being swept under the carpet....because he was been through enough, or his crimes were committed while he was a child.....Canada has sentenced children under the age of 15 for serious crimes with adult sentences before, what is the problem now. It is not the same thing, nobody forced omar to do anything....nobody put a gun to his head and forced him to kill.....if you had seen his tape his smiling face, bragging how he wanted to collect on a bounty from any Coalition soldier body.....Ya nice guy, And while the UN came up with this program, they also relieve that not all of them get a free pass, that provisions were made in that program to charge children with adult crimes if the case warranted it....in Omars case it was about a rich spoiled Canadian kid wanting tom play terrorist in the real world...not some kid from Africa that was torn from his family and force at gun point to commit crimes.... Omar always had a choice.....he could have walked up to any Coalition soldier and told him who he was ....and his whole world would have changed.....we all have choices to make, regardless of our age.....he made his, and it cost him his freedom.... I did make a choice to serve my nation, in Afghanistan to help the average Afghanis over come people like Omar and his buddies, that only wanted to force everyone to live under their brutal and oppressive rules... I don't want to rehabilitate Omars kind, I want them punished to send the message that we do not tolerate those actions......to give them a reason to take a pause and rethink their actions..... The resentment is much larger than just "our injured" the resentment stems from everything these guys did....not only to us, but to the Afghan people, the pain and suffering brought to them, on a daily basis.....they are still living with this pain and suffering....and what is Omar dealing with a few bad dreams, a couple of scars....while he lives a comfortable life here in the west, with access to food, clean water, sanitation, toilets, air conditioned homes, ..... lets not forget he took part in a action that claimed the life of a US service man.....Ya I get it he was an American soldier and he was doing his job.....He was also a father , to his children and a husband to his wife and a son to his parents....but we also sweep him and his under the same carpet, because here in Canada the US war machine is the Bad guy..... Omar and his merry band of buddies cause nothing but pain.....his group mostly made up of foreigners had no dog in the fight other than their hatred for all western nations....And Still here in Canada ....Canadians want to ensure we don't trample on any one's human rights, a noble cause, but one that has to be also put into perspective....we have been continuing to trample on anyone's rights, since day one and no sign of stopping our history is full of examples, and no one has even slowed down their busy lives to ensure they are treated with the same kid gloves as Omar.....I also get it , we need to start some where....or is this just what we do for now, to make the bad man and media go away.....Our government will be looking at each other in a few weeks going wheuuuuu crises averted and it only cost us 5 mil in fees, and 10.5 mils...in payouts.....who is next on the list for payouts.... As for the looking after our vets, That will remain the same as only our nations citizens can change that.....and they are to busy....

That is not what I am saying at all, even you know that....he is guilty by association, the men he was with ambushed those Afghanis army soldiers, meaning they already had made the decision to fight before hand...Omar was part of this group...part of that decision.

We both know that there is a is,small chance of proving very little on a battle field....this is not down town toronto with a CSI team, some pictures were taken, some hand drawings to show where everyone was thought to be, where wpns were found, where wpn fire was observed......then there was the fact all attention was then turned to saving omars life....This is war, so some thing are not going to have the same level of proof.... If he did not throw the grenade he was there when it happened, as is just as guilty as the rest of them.....

It is those governments that are above the law, no one will be held accountable, never happen.....tax payers will though.....a 10 million dollar payout is peanuts for the government, this will not give officials a second pause when making the same decision in the future....And would would not want to deprive anyone of any sleep, OP Madusa seen most of our section go 6 days no sleep....Can i sue the taliban for torturing me....He got 3 meals a day, hot showers, time to pray, to to read, time to learn.....we got showers maybe once every 2 weeks, got to use a toilet with a seat maybe once a month, got a hot meal once every 2 weeks, eat the same cold rations over and over for 6 months....got shot at at least once a day, blown up every time we left camp, all of us were covered in sand fleas, and bites from sleeping on the ground, not to mention the snakes , scorpions and everything else that was pissed off and wanted to eat you.... ....ya he had it hard i'm sure, Bush was forced to classify what is a terrorist when they UN could not....

Not sure who you aimed that at.....champions of law and order....I have already said i agree that omars had some of his basic right dismissed, and that the persons that are responsible should be held accountable.....And so should Omar be held responsible for his crimes...all of them....he does not get a pass because he was a child soldier....he had no control over his situation is bullshit.....he could have surrendered to any coalition soldier at any time, yelling he is Canadian would have meant a quick trip to the embassy.....but he was having to much fun playing terrorist....

So now your saying that not only was the SCOTUS calling it a kangaroo court, and the Canadian SC also said that his imprisonment in gitmo violated his charter of rights.....and Omar still served his time in prison......in fact the Canadian justice system locked Omar up for more than 3 years......not letting him out because both S/C's of both countries thought it was a bad judgement....but because he had served his time.....I don't like omar.....but for one looking on the outside looking in.....does that sound right to you....they proved many times that the sentence was a bogus one.....on both sides of the border...and yet omar serves his time....this is what i get out of all this....it did not make one bit of difference what the S/C on both sides thought.....or still think, they were powerless to change anything.....am i getting that right.....

On top of all the above findings.....Canada's supreme court also knew of their counter parts ruling ( US supreme court) and it does nothing except ensures Omar bunks is turned down before he sleeps in a canadian prison....and you said no one knew of this.....or no one took action on this....his defense team knew of this, they briefed his Canadian lawyer, who did nothing.....everyone just excepted his sentence...... Your sources are outdated no longer relevant, much like most of your argument about this topic....US government did alot of things while in Afghanistan, it even surveyed the route for your proposed pipe line... this was to give the Afghanistan government the info so it may move on....only a few new mines opened up, run by the chinese, i know next your going to tell me it is a US / Chinese conspiracy to drain Afghanistan of all it's riches.....That can not be the US pumped bils upon bils into afghanistan and never took anything in return.... I'm not worried your making to much fuse about something that was not there....US industry, along with Canadian industry made bils off our own governments wants and needs, industry did not need the problems of security in order to extract minerals or fuel out of the ground..... perhaps you can provide a source that proves in the afghanistan conflict, US soldiers rape and pillaged ....or is it some empty phrase you put together because the US military scares you because you don't understand the topic at hand..... maybe it is time for you to STFU.....to put it into terms you may understand.....

Your source is full of shit....Yes the US did do a surveys of afghans resources.....and yes they found lots of minerals, and while some new mines were opened up by Chinese mining companies , that is far from your claim of Afghan bring a war for profit....My question to you is why would the US spend bils fighting this war and then pull out , without stripping all these resources....not to mention the failed attempt at putting in a pipe line...that never got built, instead the same oil companies did build a new pipe line and took the long way around afghan, not through it.....

SO what your saying is there was NO one that could have brought this matter to the attention of a Canadian lawyer, who could have taken action....i find that hard to believe.... Seriously you think there is none.....all that info on his home made tapes, showing him placing IEDS on roads....not enough for you....you deny he was a terrorist, when he was a member of AL Qaida....according to him....he provided info on troop movements and convoy composition for AL Qaida....under the conventions that is providing intel to the enemy thats treason.....engaging coalition forces in a fire fight.....the same coalition our nation was part of ....thats treason....i am sure there is more....

One would think that Omars lawyers would have done that years ago....? or for that fact any Canadian citizen that wanted to act on Omars behalf.....and yet nothing on the media about anyone bringing this to Canadian SC attention. They were violated, and everyone concentrates on this one part of the entire case....what happened to all his other crimes..... B/S .....tell me there is no evidence to charge him for terrorist activities....assisting in terrorist activities, His home made tape proves that.....no confessions required for that one....read the conditions for treason and tell me there is no evidence..... I think there is lots of evidence, just not the will to bring charges , the government regardless of who was in charge at the time have done everything possible to bury this , hoping it will go away.... Canadian forces released POWs to ANA on the governments policy, CF does not set any policies with out direct government say so.

And yet the SC did not take action.....their strong words were for the media only, the fact they did not take up this so called injustice....or so says you....They did not question it....even though the US SC said it was a kangaroo court....WHY was that, not watching TV that day.....or was it that our Justice system agreed with the sentence....And now your blaming the government for controlling the justice system.....if that was a fact this would of never surfaced for another 10 years....and yet as of today he is still a convicted terrorist / murder..... I agree charter rights are charter rights, i am not or have not said anything in reference to them.....i have asked why our justice system not charged him with Canadian charges, such as terrorism, treason. etc etc....why has he not been made to answer his crimes in Afghanistan....

Not many actually lived that long, omar was a freak accident.....Notice that it has never happened again..... Actually it is more common than you think, it is mentioned in the Genva convention, inter national law.... actually try googling it instead of pulling it out your ass....I thought Omar was a Canadian under what law does he have the right to defend another nation.....google that shit to....He was a terrorist, in a foreign nation bringing terror to the people of Afghanistan, and coalition forces.....the same forces we were part of ...... He pleaded guilty to 5 crimes, NO new charges were added by Canada, why ? How many of those payouts were to terrorists...... The Canadian government was paying me to put people like young omar in the ground.....to arrange a meeting with allah, so they could collect their used 72 virgins....but you already knew this...as you just wrote your citizenship test recently ....Today i am retired, and living it up on your dime....

You seem to have forgotten that He did not serve his entire sentence in a US prison......, you seem to forget it was under the Harper government that Omar would be sent to Canada to finish his sentence....I also want to point out his time in Gitmo was that of a prisoner where he could have legally been held for the duration of the conflict, still ongoing actually.....that time does not count for squat..... He did not serve a life sentence, but i know who is the speer family will serve a life sentence without a husband , father, a son his life is gone forever....taken by a terrorist organization.... WTF more do i want....i want our nation to stand up and tell its citizens that yes we broke some laws those responsible will be punished, but we do not pay out terrorists....I want Omar held accountable for ALL his crimes....I want ALL the people of Canada to take pause and ensure we treat our soldier better than we treat our foes.....I want the Khadrs shipped back to Afghanistan to face their crimes they have committed....

SCOTUS did not hand out the sentence, in fact the tribunal handed out the sentence....And yet the Supreme court did nothing to over turn the sentences, just made some comments....Another question if the US supreme court thought it was wrong, why did the Canadian Justice system not question it......instead of agreeing to have omar finish his sentence here in Canada.

No proof.....Are we now claiming he did not work for a terrorist organization, Al-Qaida....Or did they change that law that forbids a Canadian citizen to partake in terrorist activities. Are you saying that he does not meet any of criteria for treason. How about any of the laws in Afghanistan..... Yes all US military JAGS have law degrees equivalent to civilian law degrees, i could pull that up in google if you want.....You can call it what ever you want, however the military tribunal has tried military convicts, and military prisoners of war for decades, and none of those convictions have been over turned because someone in the Supreme court did not like it...or agree with it.....Now this brings up another question, why has Our justice system agreed with the conviction, the fact that he served out the rest of his sentence in a Canadian prison.....This has got to say something.....if the sentence was bogus why was he not pull out of prison, or his conviction over turned....by our justice system.... it leaves us with More questions.....

Yes, the proper courts have turned a blind eye to all the other charges that had the proof to meet all the criteria of Canadian laws....The question is why ? Not sure where or what the "not take the word of a bunch of military wonks who really know nothing about, of have no need to respect, the due process" means, Those that served as prosecutor and defense lawyer were Military lawyers, the same qualifications as any civilian lawyer....the Military tribunal was over seen by once again military lawyers...
