One of the fundamental aspects about a justice system is it must not only be just but be seen to be done. In other words, even the appearance of bias is a bad thing, even if there is none.

I would put it to you that a KKK guy who shows up for his trial and finds a black judge waiting for him is not going to believe he's going to receive justice, and neither will his friends and family.

Trump's inflammatory language aside, I can see where he could perceive that a Hispanic or Muslim judge would not give him a fair shake.

I'm not saying he was smart to say what he said, but then he never seems to filter what's on his mind, and sometimes seems to come off like joe lunchbucket, ie, an uneducated, unsophisticated rube in his view of the world.

Of course, we all have biases and prejudices, including judges (though some people seem weirdly to believe otherwise) and judges are expected to ignore their biases. But we know they don't always do so.

A white judge would be more sympathetic to the KKK? LOL The KKK defendant might be more likely to find a racist judge if the judge is white... that's true. That's not exactly a ringing endorsement for everyone to be judged by someone of the same skin tone. That's pretty silly.

There are as many racist black judges as white judges. That isn't the point anyway. I'm saying I can see how a guy who routinely insults Hispanics would have the perception that he wouldn't get a fair shake from a Hispanic judge.

Why wouldn't he get a "fair shake"?

I think the reverse has been shown in the past to be true, more than what you're claiming. Clearly minority Americans have been discriminated against by white judges for a very long time. Many studies have shown this.

I think you may be projecting how you yourself view the world through a lens of "whites vs. coloureds" perhaps? The vast majority of people don't think that way. (thank goodness)

All judges have their biases. They just have to show that they are not, and many of them are pretty good at it. Anyone who believes otherwise, well, what more can be said. We all have our biases whether we like to admit it or not. No one is free from it.

I don't like this judge because he has bad breath

I don't like this judge because he drives a Prius

Yup, I want to get off scot free because I don't like any judge.

I'm not suggesting a course of action. I'm not suggesting we change the legal system so that Hispanic judges don't wind up sitting in cases involving people who say nasty things about Hispanics, etc. etc. I'm just saying that I recognize why he or other defendants would have that perception.

I mean, the possibility is always there, but it's still completely speculation, and this kind of thing happens all the time in the justice system. Should a male involved in sexual or domestic assault against a woman not be given a female judge? Should a black person who shoots and kills a white person not be given a white judge?

Not to mentioned that those agents of government who enforce the law on on the front lines in the first place, the police, are largely white males and that comes with its own biases etc. How does this affect what is and is not investigated (or investigated more/less rigorously than other cases)?

So Trump is basically complaining about what others have been for centuries.

I find it hard to believe that Trump would try and scam students because he knows it would get out and that is not good for business BUT on the hand ,anything possible in America, only in America.

I think he's so arrogant he would figure whatever came out he could bluster over. Apparently he's bribed the attorneys general in two states to keep them from investigating.

Uhm, I mean, he donated cash to their election campaigns. :rolleyes:

You make it appear as though this has just started with Trump, if what you say is true. This goes on all the time with big shots who have the money to buy officials. The Clinton's would more than likely know something about all of that, eh? So, just what is your point? :D
