Derek 2.0 Posted March 7, 2015 Report Posted March 7, 2015 Pound sand? Oh good grief no! I'd be terrified to be grabbed and confined like that... immobilized with anxiety ... hyperventilating ... frantic ... unable to focus or remember my name let alone my password! Of course, then if you're suspected of unlawful acts, they'll just copy your devices contents anyways, unpack your luggage for you and keep you in secondary for hours on end......fore they, after all, work 24/7......and rest assured, on future trips, you'll get to repeat the process. Yes but I'm not suspected of criminal acts. All I said was "We pay your salary for you to make old women pick up their own bags, sonny? In my day ...!" Yada Yada ... you get the drift. WWWTT Posted March 7, 2015 Report Posted March 7, 2015 There is a significant economic sector that depends on that universal right, a sector I depend on for my livelihood I might add. All the same I'd support a concerted effort to boycott travelling to countries, like ours, that maintain the sort of entry requirements one might expect of a borderline dictatorship. I'd rather sacrifice a little income now than deal with the pain of trying to eke out a living in a full-on dictatorship later. Fair enough then. I sure hope you're not on their PR payroll! Are we paying you to make them look like idiots? . Its not a threat in the slightest, but fact..........anyone that crosses a land/air border crossing into the United States has their personal info recorded and stored for upwards of 75 years...If you make an ass of yourself with US border agents (or any law enforcement) that too is recorded and could prevent you from future entry, and if you do a real humdinger, you could even get yourself on the TSA's no-fly-list...... Derek 2.0 Posted March 8, 2015 Report Posted March 8, 2015 You bet. I cross borders a lot and have always made it a point not to wind up in anyones computer as a problem. I agree, I cross over 10-15 times a year and have only gone into secondary, in both directions, maybe a dozen times, when either transporting firearms or returning on a few shopping trips with the wife........and then, both Canadian and American border agents, have been polite and I'm delayed at most 20-30 minutes. Odd that only the criminals and jerks are hassled Quote
On Guard for Thee Posted March 8, 2015 Report Posted March 8, 2015 Here is something many may not have had the pleasure of...I worked in Iran for a while and so had a visa for that. Crossing the US border from Canada with that same passport provided some seriously raised eyebrows. Quote

overthere Posted March 8, 2015 Report Posted March 8, 2015 And the result, your phone/computer will be seized if enough of a scene is made, and the CBSA will put you in cells and obtain a warrant to legally unlock it themselves......that ought to learn them. Only the first part will happen, and only if they have some reason to eblieve it may contain something illegal such as child porn. Once CBSA has determined your identity/CDN citizenship and seized the phone/computer while they obtain a warrant o search it- you'll be released. Of course, they will have to provide evdience before a court to get a warrqant to break into the phone/computer. Charges may come from failing to provide a passowrd, or from the actaul contents of the device, but they cannot detain you more than a short time. Quote Science too hard for you? Try religion!
cybercoma Posted March 8, 2015 Report Posted March 8, 2015 The guards can ask for the password, but you are of no obligation to provide said password. IF they hack it without a warrant, that would be illegal. That's wrong. There was a Supreme Court ruling in December that allows police to search your cellphone without a warrant. CBSA has the authority to search you when you enter the country. Therefore, CBSA has the right to search your cellphone without a warrant and you are required to offer up the password. Failure to do so is obstructing a Border Service Officer and is illegal. It was a BS decision by the Supreme Court, likely due to significant ignorance around the use of cellphones. They don't see text messages and emails like they see letter mail and they should. Nevertheless, as it stands now, you must provide your password to both police while you're under arrest and it's extremely likely that the same will apply to CBSA should this one go to court. Quote

cybercoma Posted March 8, 2015 Report Posted March 8, 2015 There is no such thing as 'simplistic' when it comes to laws, particularly constitutional laws. You cannot simply read it and say, well 'that's that'.This is absolutely ironic coming from the poster who has spent the most time saying the laws ARE in fact black and white and that judges are reading into them things that aren't there.
