cybercoma Posted February 23, 2012 Author Report Posted February 23, 2012 (edited) I can't see it going terribly far; it seems unconstitutional for a couple of reasons: One, it mandates punnishments with a severity that doesn't match that of the crime; this was noted by a judge in a recent gun crime case. Two, it is a federal law that requires provincial governments to spend money they didn't agree to spend. Why the latter hasn't been the basis for a court case yet, I can't understand. Im comfortable with the ammount of crime. Obviously having no crime would be ideal but you could spend our entire GDP on that and never achieve it. I feel like I am safe enough, and dont want to spend more money to be a bit safer. The Canadian government is doing their damn best to turn me into a libertarian. Iv never been very supportive of a micharchist adgenda, but when every single thing our government does is stupid and harmful, the idea of a small and highly limited government is starting to appeal to me. A reference question can be put to the Supreme Court by a government asking if a bill is constitutional, though the court's ruling is not binding (though, no government has so far ignored an answer to a reference question). Still, because of that recent gun crime case wherein the judge struck down the mandatory sentence prescribed as unconstitutional, I mistakenly thought the bill in question here had already been passed. Sterling was one of the people in the US that helped draft mandatory minimum legislation in the 1980s. He supported it and has seen first-hand that it does not work, but rather causes more damage. To be honest though it does seem Harper is as soft as anyone on moral turpitude, for the moment at least. I wonder if anyone has tracked whether the mere suggestion of being subjected to online surveillance by the state has deterred people from surfing porn? If it has it probably bodes well for the states development of future moral engineering projects. For all we know the brave face Canadians are putting on and effectively declaring to be with the child pornographers masks a populace that is more suggestible and malleable to the will of the state than the state thinks. That said I often get the sense that even if Harper himself were caught buggering some kid he'd still be able to count on at least 12.5% of the electorate to vote for him. You know under the new law passed by the CONSERVATIVES pedophiles on average will go to jail for less time then those growing 6 pot plants right?
