The Federal Court of Canada has ordered the federal government to allow the return of a Montreal man stranded in Sudan for six years as an al-Qaeda suspect, arguing his charter rights have been breached.

Abousfian Abdelrazik, 47, was arrested and detained while visiting his mother in Sudan in 2003. For the last year, he has been living in the Canadian Embassy in Khartoum.

Both the RCMP and Canadian Security Intelligence Service have cleared Abdelrazik of any terrorist connections, but the Conservative government refuses to issue him travel documents to return home because his name was added to a UN Security Council list banning travel for terrorist suspects.

His lawyers successfully argued the government has violated his right to mobility under Section 6 of the Canadian Charter of Rights and Freedoms.

In the court's decision Thursday, Federal Court Judge Russell Zinn wrote that Abdelrazik is a "prisoner in a foreign land" and "as much a victim of international terrorism as the innocent persons whose lives have been taken by recent barbaric acts of terrorists."

He ordered the government to facilitate Abdelrazik's return within 30 days. The government hasn't said whether it will appeal the decision.

"I find that Mr. Abdelrazik is entitled to an appropriate remedy which, in the unique circumstances of his situation, requires that the Canadian government take immediate action so that Mr. Abdelrazik is returned to Canada," Zinn wrote.

How? IT shows that more than one government has been wrong on their stance on this. Every Canadian has the right to enter and leave Canada.

It's important to any Canadian who wants to be able to leave the country, and then come home again.

Freedom isn't something you 'have': It's something you work to keep every day.

it's important because it shows how Harper continues to refuse Canadian citizen's rights. He wants to ignore Omar Khadr and Abdelrazik in the immature hope that they'll just go away... That he won't have to deal with such serious subjects... Harper would cheat his way through an exam if given the option.

So a guy from Montreal - probably an immigrant from Sudan - who obviously had money to get here from Sudan and money to return to Sudan - goes to the Sudan - gets into trouble and was told to stay there by libs as well.

Somehow gets his name on a UN Security Council list - this is because he is such a nice boy after all - I have been told many times by waldo and smallc and their ilk that the UN is a respected organization.

He is supposedly cleared by our folks - who obviously travelled to that God forsaken country and completed an investigation? Yeah - not frigging likely. RCMP have so much capability in Sudan. :lol:

So - when does his name come off the worshipped UN "list" during the time of lib rule ?

Perhaps they know something we do not?

Courts love the law - I am more interested in the security of my country and my family.

No judge in Canada would say no for the sake of security. He is a person who would never say no for security if the law backed his decisions - proving yet again the law is an ass and its many worshippers are simply ass kissers.

Which is why a judge should NEVER have a say. They and the vast majority of lawyers would sell their mothers, their daughters and their souls for 30 silver pieces - and judges are the worst as they have milked the system to the max and now are working to do the same on the other side of the system.

Nice political move by someone from the Sudan who obviously has some serious money backing to pay for all this legal stuff.

Until this guy is removed from the UN Security Council list of terrorists - no judge has the right to bring him back - and I am glad the government has made this decision. I am fairly certain the libs have done this in the past as well.

Having been to Sudan - criminals have money - citizens have none - criminals send their people out of country to have children, open new illegal ventures, etc. Hell seems to me one leader from that part of the world even had all his children born in Montreal. Canada does have around 40K immigrants that are deemed dangerous and are to be deported - yet they cannot be found - this guy has a known location and can stay for now. Montreal has a population of people from this part of the world - many of them are not the type of people you want living next to you.

This guy can stay in Sudan forever - not going to miss him - he went back for more than "family" reasons.

More to this than meets the eye or some lefty news report.

Harper is not the first PM to do this - and the wonderful, ethical UN supports this decision it would seem. In fact Harper is only following the UN advice - something people who worship the UN should be happy about.

I find this quite funny seeing as how I was recently told the UN is a great organization. :lol::lol:

Unfortunately in Canada the law will always trump national security unless someone steps up to put the lawyers, judges and legal system in its place.

I am sure the bleeding hearts here will tear themselves apart and put on their hair shirts - off you go now folks - remember the lib heroes from days gone by supported this move as well.

- Abdelrazik is on the UN no-fly list at the behest of the Bush era United States

- Abdelrazik has been cleared of any associations to "terrorism/terrorists" by CSIS, the RCMP and the Sudanese government

- Canada has formally asked the UN to remove Abdelrazik from the UN no-fly list... a de-listing that has not occurred simply because the Americans have not supported it

- the Conservative government has thrown up a series of repeated challenges/denials to allow Abdelrazik to return to Canada

- Abdelrazik qualifies as an allowed exception under the UN's own travel ban restrictions for persons on the UN no-fly list.... the exception that allows for the listed person to travel to their country of citizenship. Conservative Minister of Foreign Affairs, Lawrence Cannon, has denied the return of Abdelrazik under this allowed exception.

Governments have not only the right, but the responsibility to respond to concerns about terrorism and protect their citizens. However, any government actions must conform with international human rights law including protections against torture, and arbitrary arrest and detention.

I am sure he will arrive in Canada some day - I have not derided the UN - you dick head - I simply stated I was told it was a great organization - it is now preventing your wonderful Canadian from coming home - some day that will be lifted - until then he can stay where he is at - he has been there for a few years and not been missed - a little longer will not hurt.

The legal system of this country does not help us in our security - far too many people have been ordered out and nothing has been done - perhaps this one is another Canadian of convenience

Why don't you go and join him - I am sure misery loves company :lol:

You say he has been cleared by Sudan. Then why doesn't he just leave the embassy, hop on a boat and come home?

He does have the ticket to come home but Canada was barring him from doing so. First, they told him to get the money for the ticket and they would allow him to come home. A group of Canadians got some money together and sent him the ticket, but then the government changed its mind anf from wha the opposition parties have been saying he has been cleared of any charges of be a terrorist, including the UN, it just mean old Tory party stopping him. So now they are stalling because the justice minister says they have to read the 100 page report first. I'm sure they will go to court to stop him from staying here. He has to appear before a Canadian court this week or next so they have to let him come home.

Did you read the artical he was stuck there for six years, that means the liberals stranded him, the conservatives continued the policy. So in summary your precious liberals are just as guilty.

oh really - wind that 2003 clock back to the time/events it takes to engage/resolve (re: CSIS, RCMP and the Sudanese government). Now move that clock forward, particularly to the post 2006 time frame... it's very clear, in a precisely mapped out time/events sequence, exactly how this Harper Conservative government has stalled/manipulated and falsely denied the rightful return of Abdelrazik to Canada. Shameful!

Borg, IF Harper thinks him to be a terrorists, then why is Harper letting him stay at a Canadian Embassy? The only thing stopping him from coming home is a passport which the Tories have to give him and is stalling to do so but they have no choice. I like to see Nicholson go to jail for not following orders by a judge!

Quite true. Regardless of the theories spouted by a few individuals here, a citizen's right to enter the country is not just guaranteed by statute law, it's constitutionally provided. From the Constitution Act, 1982:

6.1 Every citizen of Canada has the right to enter, remain in, and leave Canada.

No matter what we think of an individual Canadian, he or she cannot be denied entry into their own country.
