CERN: Climate Models will need to be revised
charter.rights replied to Pliny's topic in Health, Science and Technology
In Al Gore's "An Inconvenient Truth" I remember Gore specifically stating that CO2 is not the only GHG affecting the ozone layer. However, because CO2 has been traced since about 1958 (the Keeling Curve) it provides a strong indication of the actual accumulations of GHGs in the atmosphere. Increases in CO2 indicate that the other more volatile GHGs are increasing at an equal or greater rate. -
Wild Bill had to create a straw man fallacy because there is no legitimate support for his point of view.

Canada doesn't have to abrogate authority. The UN's authority exists above and beyond what Canada thinks or wants. Just ask Muammar Gaddafi. International rights are protected and enforced by the international community.

ROTFLOL Mr. Internet Tough Guy? Wrong. You have merely repeated common myth that does not resemble legal reality. Most of the land Canada sits on has never been ceded, and the Supreme Court has consistently held that conveys an absolute aboriginal right - a plenum dominum, absolute title - over land. The result is that WE have to negotiate with the affected First Nation, before we can move forward, regardless if we knew beforehand whether or not the affected First Nation holds an interest in it. Aboriginal rights go beyond our own rights protected by the Charter. At face value that would appear that we have been subjugated by the Crown where First Nations have not. Despite that persistent ineptness you displayed with your former post, your pretending that aboriginal people have been conquered has no factual basis. Rather it appears that they were much smarter than the framers of the treaties, having convinced the court that what is written is not what is meant. And thus their oral history is given equal or better weight in court than any of our dumber ancestors. It is highly unlikely that you are as well read as you think you are. You know Archie comics do not count as reading material (although they did at one time qualify as bathroom material). I highly doubt that you are as smart as the dumbest here among you given your propensity for making idiotic non-factual statements. Unfortunately, there are many who share your affliction and more unfortunately there is no cure for their stupidity either.

Of course, you are a dreamer.
-
Well, no. Not like the rest of us. In fact First Nations by their virtue are not Canadian. ~Some~ aboriginal people might count themselves as Canadian but most First Nations people choose their nation of origin to be identified with. Nowhere in time, law or history has Canada ever legally obtained dominion over First Nations, their land or their citizenship.

And BTW. First Nations people are not Canadians unless they "choose" to be. That is one more freedom they have that we were not born with.

I get that you may not very be smart, but it might help to look in a book now and then, or learn how to use a search engine BEFORE you make inept comments. First Nations have never been conquered. In fact if you read the treaties and the Supreme Court rulings that go along with them, you will find that we ended up with the shorter straw. Those treaties apparently are binding as long as the sun shines, the rivers flow and the grass grows.....forever.... Aboriginal rights on the other hand are exempt from the kinds of stipulations, laws and regulations that most of us are plagued by. Their freedoms are much more desirable than ours. Their potential much greater than our potential - not being saddled with unfair taxation, and burdened with the rules under which we create our opportunities. They still hold title to much of Canada, and hold extensive rights over the balance of it. We are the renters. We are beholding to First Nations. And as their legal rights are justified and quantified by the courts, we stand to lose much more than we have gained. I would suggest that you like the rest of us, are a loser in those deals. But given your ignorant statements that are beyond the justification of a decent education on aboriginal issues, I would suggest that it is pretty predictable on first glance.

Laws and rights exist because of agreement. Our social contract - the Charter of Rights and Freedoms - is that agreement to act and behave in a way that is Canadian. It too is nothing but a figment of our collective imagination, but nonetheless binding in a civil society. However, in that context (and the context of all law) Aboriginal rights exist beyond the borders of Canada's recognition. The United nations Declaration on the Rights of Indigenous Peoples is a prime example of those rights that are internationally protected. The fact that Canada not only signed on but was in many ways the architect of the Declaration is evidence that we hold to the international contract of protection of rights and civility far beyond the borders or limited mindset of some smallc Canadians.

And we have never received the right to live off their lands and resources in most of Canada.

You need to read the Charter of Rights and Freedoms silly boy. "25. The guarantee in this Charter of certain rights and freedoms shall not be construed so as to abrogate or derogate from any aboriginal, treaty or other rights or freedoms that pertain to the aboriginal peoples of Canada..." Meaning, no other right or freedom in the Charter can diminish aboriginal or treaty rights. Attacks against aboriginal people of any nation has been met with sanctions and the use of force backed by the UN Security Council. Perpetrators of genocide have been tried before the world court. Aboriginal people are not Canadians. They are nations whom the Supreme Court has for the last 30 years been chastising and reversing the acts of government that violate aboriginal and treaty rights. The Charter holds that aboriginal rights are "recognized and affirmed". Rights are not granted by the will of the government or the will of Canadians. Aboriginal rights are rights which have been recognized and protected under the law for over 250 years. Treaties are nation to nation agreements.
-
Wrong. Aboriginal rights are different. They are not conferred by the state and are therefore outside of the state's control. Rather aboriginal rights are international human rights, recognized internationally and protected under the United Nations Charter. As suggested by jacee, aboriginal rights are recognized by Canada, as being outside of their realm of jurisdiction.

I think they could make the merger work. What would be key is for each party faction (of the merged parties)to maintain their caucus, allowing free discussion of the issues from each perspective. The new party caucus would then be made up of both former party members and would work to find consensus. That would leave individual members with their core values yet create a unified opposition and a viable alternative to the Conservatives.

CBC was granted a 1 year extension by the CRTC. They will still be transmitting an analog signal.
-
I agree. Playing the "I'm a Conservative and I'm the victim" crap is about as childish as you can get.

Major Bust On Reserves In Quebec
charter.rights replied to AngusThermopyle's topic in Provincial Politics in Canada
Nope. They violated the Mohawk's Charter rights.Search and seizure on any reserves MUST be approved by the Band Council BEFORE the execution. The Supreme Court has held that Provincial Court orders are not applicable on reserve. Therefore, it the search warrants were executed improperly, it will mean the charges will be thrown out. -
Major Bust On Reserves In Quebec

Marijuana is not a prohibited substance in the possession of First Nations people. Their possession of all traditional medicines, including peyote and other hallucinogens are a protected right under the Charter. It may also be traded among other aboriginal people. -
Suspended then.M.Dancer was suspended too?

Shwa got banned and it looks like Oleg got banned too. Anyone else?

Don't be so childish. Clearly Brown was interested in extorting as much as he could. And clearly he was a crackpot. The numerous false alarms they made to the police supported the hysteria they were trying to generate. The rest of your hyperbole isn't worth discussing.
-
Dave Brown and Dana Chatwell were well known to be intoxicated sh$$t disturbers who made false alarm called the police on countless occasions. They were never denied police service however, because their house was being policed by Six Nation Police Services and THEY refused to be policed by natives. You sources are corrupt and blatantly racist sites. And those townsfolk as you call them were rejected by the rest of Caledonia as sh$$t disturbers too. Tell me which one is you?
