Her case had no merit or grounds. no - the ruling was that the court did not have standing to rule on political decisions concerning the membership of Cabinet. the, as you say, "merits or grounds" of the accusation were not tested... were not ruled upon. In regards the particular defamation allegation, interestingly, Harper's 'legal team' did put forward a statement that, "Harper and the other defendants had not committed defamation, but even if they had, they were protected from lawsuits by the doctrines of Crown prerogative and absolute and Parliamentary privilege"..... membership has its privileges!
