Under current law, a refugee or asylee is defined as someone unable or unwilling to return to their home country due to a well-founded fear of persecution based on race, religion, nationality, political opinion, or membership in a particular social group. USCIS (.gov) +4 Proposals aimed at restricting this definition generally include: Raising the Burden of Proof: Increasing the required probability of persecution from "well-founded fear" to a higher standard, such as "more likely than not" (similar to the current standard for withholding of removal). Restricting "Particular Social Group" (PSG): Narrowing the legal interpretation of PSGs to exclude, for example, victims of gang violence or domestic violence, by requiring that such groups be defined independently of the persecution they suffer. Implementing "Safe Third Country" Policies: Requiring asylum seekers to first apply for asylum in the first safe country they pass through on their way to the U.S., making them ineligible if they did not do so. Defining "Persecutor": Tightening definitions to exclude individuals who have, even under duress, assisted in any way in the persecution of others, or those who participated in illegal activity, including unauthorized border crossing. Limiting "Political Opinion": Narrowing the definition of political opinion to exclude acts of violence or crimes, ensuring it only covers legitimate, non-violent political dissent. Stricter Interpretation of "Unwilling or Unable" to Return: Requiring proof that the applicant cannot relocate to any other part of their home country, not just their hometown. Increased Use of Mandatory Bars: Expanding mandatory bars to asylum, such as stricter application of the one-year filing deadline, or barring individuals who pose a, or are deemed to pose a, public health or security Or we could just do away with all of it and use the money and resources on our own citizens.
