Broken Justice

Can anyone make a plausible excuse for why this guy was approved for parole? Because I frankly can't think of one. Maybe the parole board was figuring that the next woman he raped and likely killed would probably only be an American anyway. Frankly, if a guy ever qualified for a bullet behind the ear, this is that guy.

When violent rapist William Shrubsall received a rare indeterminate prison sentence in 2001, a Nova Scotia judge ruled that if he ever regained his freedom, the likely result would be more dead, injured and psychologically scarred women.

There was no “realistic prospect of controlling the threat of dangerousness” from his re-entry into society, reads the ruling.

Only 18 years later, despite warnings from his victims, his prosecutor and even the Correctional Service of Canada, Shrubsall has been granted full parole and is to be deported to the United States. Given that his prison term could be as short as 2 and a third years, he could conceivably be free before his 50th birthday.

How deadly is the fentanyl epidemic? Not very. At least, not according to a BC judge who appeared to be eager, if not desperate to find a reason to acquit a man caught with 27,000 fentanyl pills. According to the judge, the police dog's behaviour that showed there were drugs in the car might have been just 'ambiguous'. So he set free the drug dealer with a smile and a pat on the head.

Another idiot who got on the bench in BC through knowing the right people has ruled a man is guilty of using his cell phone while driving even though it had a dead, battery and was in the glove compartment of his car. I swear we need IQ tests for judges in this country.

So once again Canada's ultra-liberal judges, weeping with sympathy and wringing their hands at the thought of punishing a mass murderer too severely, have decided to change the law. They do it fairly frequently simply by deciding to 'interpret' the constitution however they feel like doing so.

This time they've decided that consecutive sentences for multiple murders or anything else are 'cruel and unusual punishment' and thus against the constitution. Bear in mind that the way the law works judges could decide forcing a mass murderer to stand in the corner for an hour was too 'cruel and unusual'. There are no limits on how they can impose their bleeding heart ignorance on the rest of us.

This was on the mosque shooter, but it will, if sustained by the supreme court, apply to all other murderers. Just because someone kills five or ten or twenty people doesn't mean we can require they serve long sentences, after all. That would violate their right to 'life, liberty and security of the person'.

Justice in Canada is so very... just! So stern and righteous!

Today we learn that a two-time murderer escaped from a minimum security native 'healing lodge' a couple of days ago.

Alexson, 51, is serving an indeterminate sentence for two counts of second-degree murder and for arson, escape from lawful custody, prison breach with intent, assault against a peace officer and break and enter with intent.

Just the kind of sweet, misunderstood guy who only needs the wise native elders to set him on the road to righteousness.

OR as a conservative might ask -- why was this scumbag repeat offender at a minimum security native healing lodge to begin with?

Everything connected with law and justice is a rather controversial issue. It's not a rare thing when an innocent man gets imprisoned or vice versa, a guilty one stays unpunished. I guess everyone should know their rights and responsibilities just to feel more protected, you know. That's why I really want to start my study of law. I plan to do it here, ucmjdefense.com, if you're interested. Sometimes I feel anxious about the power of judges and thoughts of going to prison due to someone's mistake or something like that. But I still believe in our legal system.

Watch the Nygard documentary talking of a broken justice. It wasn't even middle ages or some centuries. You could still do that in the 1990-s Canada, a world-leading torch of democracy. Wow.

Sure CBC investigated... three decades later. And in another two we may hear an apology!
