If a judge throws out a case where there is evidence that "may" prove guilt,the crown can essentially complain and the judge will find themeself out on the freeekin street? Man thats freekin funny! That's why the distribution of alcohol is restricted. Bars can lose their licences for serving minors. Stores can lose their right to sell and be fined. Clearly the government, responding to the expressed wishes of the people, believes mind altering substances ought to be kept out of the hands (as much as possible) of minors. I suppose you're aware that in most provinces a 12 year old can actually drink rye in the home under the supervision of his/her parents. Quote

I didn't say the law wasn't a little odd, or didn't have odd applications. Yes, you can serve alcohol to your own kid in your own home, but if that kid turns up drunk somewhere because you supplied the liquor I suspect you'll be charged with child abuse. Supreme court justices do not usually publically critisize federal legislation. This underscores how out of touch Ottawa is with the provinces. But perhaps more importantly, the federal strategy seems bereft of any understanding of what's happening in the provinces, which are responsible for delivering justice and maintaining the legal system.And that may have triggered Justice Baumann's restrained but sharp comments. The B.C. legal system has been subjected to severe restructuring and cutbacks since the provincial Liberals took office a decade ago. The problems have made headlines, be it courtrooms closing because of a shortage of sheriffs or dockets so clotted you can't get a trial date in less than year. Cases are regularly thrown out in Provincial Court because it has taken too long for them to get to trial. Heck, we had a riot in Vancouver and three months later, not a single charge has been laid yet. On one hand we have the BC Liberals closing down court houses, and firing court reporters and sherrifs, because we cant afford them. On the other hand we have Ottawa writing laws that hand out harsher punishments to small time growers than they hand out to child molesters. And the conservatives are trying to cut off debate on this bill before the Parliamentary Budget Office can author a report on what it will cost provinces. Quote I question things because I am human. I can see the rationale behind thinking most of the really egregious chunks of the crime bill will go nowhere, because the judiciary and legal community simply won't stand for them, but all the same...why even go down this stupid road?
