Forty-five women and girls -- one only 12 years old -- from Winnipeg and Brandon allegedly had unprotected sex with a Winnipeg man infected with HIV, the virus that causes AIDS, police said yesterday.

The growing investigation into Clato Lual Mabior is now the largest of its kind in Canada, Winnipeg police sex crimes Staff Sgt. Brant Bishop said.

"This is potentially a pretty serious health issue," Bishop said. "I would suggest the numbers could be much greater."

That's because many of the women involved -- only eight have been interviewed by detectives so far -- may have had unprotected sexual relations with other men, potentially and unknowingly spreading the disease.

Mabior, 28, is now charged with multiple counts of aggravated sexual assault.

Bishop said the maximum penalty if a person is convicted of aggravated sexual assault is life in prison.
Mabior, a Sudanese refugee, is in custody at Headingley Correctional Institute.

Mabior was the subject last month of an unprecedented warning by police and the Winnipeg Regional Health Authority, who said he was allegedly having sexual relations with women without telling them he was infected with HIV.

Anyone having had any type of unprotected intimate relations with Mabior should seek a doctor right away and call police at 986-3385.

Bishop said two other men are now implicated in the investigation. Gabriel Deng, 27, has been charged with sexual assault, sexual interference and sexual touching. The third man's name was not released as his case remains under investigation. Both are believed to be friends of Mabior.

Bishop said Mabior has now been charged with having unprotected sex with five other girls and women in Brandon and Winnipeg. Mabior lived in Brandon from November 2003 to March 2004, when he worked for Maple Leaf Foods. The ages of the partners are 21, 22, 18 and 12 and 15.

Many of the young women were runaways or supposed to be under care of Child and Family Services, Bishop said.

"They were being preyed upon," he said. "They were plied by alcohol, drugs and the offer of a place to stay."

Bishop also said the investigation and others like it could run a lot smoother if investigators could get personal medical information about victims and the accused a lot more quickly. He blamed the province's Personal Health Information Act (PHIA).
"Quite frankly, this a public safety issue," Bishop said. "What's the greater good? The protection of one person or the protection of the public?"

The PHIA, proclaimed in December 1997, was the first legislation of its kind in Canada designed to protect a patient's privacy rights concerning the release and use of personal health information.

Bishop said many health-care workers are frightened to discuss a person's medical status, even with police, because they face a fine of up to $50,000 if personal information is wrongly disclosed.

"It's incredibly frustrating," he said. "I think it's time we look at that legislation. The number of people who can be infected in such a short period of time is quite profound."

Far be it from me to defend this scumbag. But I live in Winnipeg, and this was covered widely at the time. I also don't see the word rape anywhere in the post, and from what I remember of the coverage it wasn't called rape at all. However, he had sex with many women and young girls (an argument for statutory rape can be made in these cases), knowing he was HIV positive, and that makes him a disgusting piece of garbage. I'm sure when the trial commences we will get to read all the lurid details.

You are correct, the article and the facts of this case do not call it rape, but aggravated assault.

Where he copied the entire article to post here, they have been calling it rape....but that site and it's fans are as about as honest as they are smert.

In Canada the word rape, in reference to domestic cases, has been 'passe' for years and is generally referred to as 'sexual assault'.
