Detention The exercise of an element of physical constraint of an individual. "Kidnapping (is) the stealing and carrying away, or secreting of any person of any age or either sex against the will of such a person, or if he be a minor, against the will of his friends or lawful guardians, http://www.duhaime.org/LegalDictionary I don't know why you fail to see the difference between the two. What the shop keeper did was a citizens arrest with the detention until the authorities arrived. The shop keeper was not secreting away the person. You very much are.

http://www.mapleleafweb.com/forums//index.php?showtopic=16862&view=findpost&p=580744 So in that thread you support statistical representations but because in this thread on justice it doesn't support your claims, you don't support them. So small c do you support statistical representations or not because you are either blowing hot air in this thread or you were spewing it the thread for Ontario ER waits.

It has increased by 10 officers per 100000 of people. Yet the stats on solved crimes have not increased nor have the rates of reporting crimes, can you explain small c. Funny how you will accept one stat report from stats Canada but not another. Why the selective acceptance of stats Canada's reports small c. What the shop keeper did was not kidnapping. kid·nap [kid-nap] Show IPA –verb (used with object), -napped or -naped, -nap·ping or -nap·ing. to steal, carry off, or abduct by force or fraud, esp. for use as a hostage or to extract ransom. http://dictionary.reference.com/browse/kidnap Was the criminal used as a hostage or to extract a ransome? Nope he was held until the police could come and take custody. A little bit of a difference small c. The criminal was detained, I will define that for you too since you don't seem to understand the difference between the terms. de·tain [dih-teyn] Show IPA –verb (used with object) 1. to keep from proceeding; keep waiting; delay. 2. to keep under restraint or in custody. 3. Obsolete . to keep back or withhold, as from a person. http://dictionary.reference.com/browse/detain

You have a stat that backs this up? Because this goes against what you are asserting http://www.statcan.gc.ca/daily-quotidien/100928/dq100928a-eng.htm? Why are fewer people reporting crimes and victimization small c? Would cases like this shop keeper have something to do with it?

"A government that fails to fulfill its responsibility is not a legitimate government, thus, citizens aren't obligated to recognize its legitimacy"- John Locke. By the police not dealing with these situations the government is failing to fulfill its responsibility.

The criminal code allows citizen arrest or as you have begun to call it vigilantism. http://en.wikipedia.org/wiki/Citizen's_arrest#Canada
-
Then you must have a real problem with the police using physical force to bring citizens under control, even though they may not be threating any persons including themselves.
-
I am guessing you never read the bill of rights.
-
The bill of rights did deal with the situation better then the charter, too bad John didn't entrench it like the charter was. The fact that it was changeable is immaterial to the discussion since we are talking about how the the charter vs the bill of rights would have specifically dealt with this situation.

you bet it is, it effects the lively hood of a rancher, remember for some these aren't toys, quads are tools.
-
John Diefenbaker's bill of rights dealt with these issues much bet then garbage trudeau left us with.
-
Two men stole his quad, he shot at them in defense of his property. Mind you the closest responding police station is more then 45 minutes away if they decide to respond. One was held until the police finally arrived a couple of hours later.

I did not say common knowledge or common belief, I said common sense. common sense Function: noun Date: 1726 : sound and prudent judgment based on a simple perception of the situation or facts http://www.merriam-webster.com/netdict/common%20sense Common sense, roughly speaking, is what people in common would agree: that which they "sense" in common as their shared natural understanding. Some use the phrase to refer to beliefs or propositions that in their opinion they consider would in most people's experience be prudent and of sound judgment, without dependence upon esoteric knowledge or study or research, but based upon what is believed to be knowledge held by people "in common". http://en.wikiquote.org/wiki/Common_sense

Please tell me why Brian knight is fighting a court battle because he decided to defend his property,if we all ready have these rights?
-
WOW! So you disagree with the philosophy of Aristotle? You know it was quite central to John Locke's ideas right?
-
The problem is that we don't have property rights, we have no right to defend what is ours. If the idiot leader of the liberal party in 1982 would have been a 'real' classical liberal we would have had property rights in our charter of rights, instead he gave us what amounts to a mess.

Here are the relevant details the criminal stole, the shop owner stopped him held him until the police responded. Had the criminal not stolen from the shop owner the shop owner would not have had to hold him until the cops arrived. I imagine your ignorance stops you from using common sense and siding with the real victim.

No that would be what money grubbing lawyers have made it about.

I loved the look the f-14 it just oozed power a beautiful aircraft that has always been my favorite. -
BS holding the criminal until the authorities arrive is completely appropriate.
-
This is garbage, its putting the criminals rights above the victims. No wonder canadian society is such a mess.

Mackay Cancells Imam's Speech due to "Extremism"

Hey you said they (the tea party) want a pure laissez-faire capitalism system, yet you have produced no evidence that anyone in the tea party has stated this as goal. What has been called for is a reduction in the size of government (civil service). Did you know that regulations don't equal larger government, did you know that it is possible for industry to self police for infractions of regulations, or even heaven forbid self regulate? Did you know that in your beloved Ontario there are industries that self regulate to a standard higher then that of the regulations passed by your own MPPs? Did you know that the government isn't always the answer? In fact its seldom the best answer just the knee jerk reaction of those that want others to solve there problems for them. -

http://www.thefreedictionary.com/heightened Khrushchev's reforms raised or increased the quantity or degree of ideological differences In other words small differences that were inconsequential before the Khrushchev reforms were heightened making a change in idealogical position. Just like there are many types of liberals ie classical, egalitarian, economic, social, welfare-state, ethical, humanist, deontological, perfectionist, democratic, and institutional, but they are all liberals. Or are you trying to tell me that marxism is marxism and that there shall be no deviation in interpretation to communist manifesto? I guess that means for liberals there shall be no deviation from the strict interpretation of John Locke? You must think that the current and past liberal party of Canada must be an aberration of liberalism. Considering John Locke's main philosophy of liberalism discussed in Natural Law being that fundamental rights can not be surrendered but must be enshrined and protected. The three fundamental rights were life liberty and estate (property). Please tell me, were all three of these enshrined by the liberal party in 1982, or was one missing? Rhetorical question of course one is missing, the liberal party of canada forgot to enshrine one of these fundamental rights taught by the father of liberalism, the right to own property. So lets put it this way if you think the Maoists in China were not Marxists but an aberration of communism, then the liberals of canada are aberrations of liberalism.
