  2. Under the _law_ teh gov't can choose to expropriate any property. If there is a dispute in ownership the gov't is allowed to pass legislation to grant title to whomever it wants. I don't understand why you find it so diffult to understand that this is a political issue and the legalities are irrelevant. Six Nations has no power to compel the gov't to do anything that it feels is not in the public interest. Why won't you simply acknowledge this reality? Well I think Tsi and already flamed you on that argument. Your talking circles around yourself. The last time you told us you could get your government to change the law at your whim. How can it be political when it's law. If legalities are irrelevant then why do you continue insisting we broke law. You don't know what the hell you're talking about! All the Six Nation's chiefs should be jailed. If a union leader, for example, encouraged violence and destruction from his members, he'd see prision. Why don't Indians, why the double standard? If you're refering to Oka (the only place there were weapons) we didn't walk into the town of Oka the incident took place and we remained on our own territory. With the exception of our own people there were no civilians near us. Our Nation was under seige and we deployed our army to defend ourselves in our home. I suspect you don't have a clue what went on there aside from the what media put out. The money our communities recieve is from the land that was already purchased that your Crown holds. The land that was taken without compensation is land the stolen land. As you say, get your facts straight before you go flapping your jaws. Lets look at your agenda; You're willing to commit National and cultural genocide on us in order to force us comply to your demand that we should be Canadians. You wish to cancel the payments we recieve for land sold in the past and still feel you should keep it. You believe Canada owns all of the land and none of it belongs to us. Under your law when you fail to pay a mortgage or rent you are evicted. Refusal to vacate is followed by the physical removal of the former tenant. Yet you feel we are commiting some heinous crime for doing the same. I can see what your agenda is adding up to.
  7. Prove it - where is this agreement in principal? If your legal case was so air tight then you would have never needed to blockade the Caledonia development. If it wasn't why would your government want to settle the matter out of court?

I will make it very simple.Canada has something Six Nations wants. Canada is not going to give it to Six Nations no matter what the laws or Six Nations, Britain or any other country say. What is Six Nations going to do about that? So what you're saying is Canada disregards it own laws and will take what they want when they want it?   9. I'm not answering for 'Tsi Nikayen' Enonhne I'd just like to post my own answer. You don't have to be a Canadian to know Kanata is a great country. People visit Kanata from all around the world. From our ancestors to the present our people have given their lives in its defence. The same cannot be said for some of its inhabitants. Under the guise of racism they wittingly seek to commit genocide on the country's indigenous people. They accuse us of thinking we're more superior then they when all the while they are of the opinion that we must conform to their standards. They discuss how easily their laws can be changed at their whim yet, rather than standing up to that government and demanding the imposed tax under the war measures act be abolished they complain that we don't pay taxes. They object to centuries old agreements between our governments that are recognized and affirmed within their modern constitution but, don't seem to mind the agreements with governments of other nations they pour money into. They accuse us of breaking the law while they disregard them. They seek to chastise us for standing up to their government when they don't have the courage to. O.K. deal! You can collect the over $250 billion that a former Mayor of Brantford publicly stated they owe us on land leases in Brantford alone. Thats were the money comes from it's not a "hand out". When you collect it there'll be no need for this conversation. Gate 3 is now boarding for Europe don't miss your flight!

It's based solely on the fact that we are the indigenous inhabitors and the colonists made agreements with us. Pauline Johnson's mother Emily was English and adopted into the Mohawk Nation, Mary Jemison was also English and adopted by the Senecas and there were hundreds more. They were entitled to the same benefits and agreements as the rest of the Nations! Racism? I think not!!!

Consent (3) No proceeding for an offence under this section shall be instituted without the consent of the Attorney General. Definition of “identifiable group” (4) In this section, “identifiable group” means any section of the public distinguished by colour, race, religion, ethnic origin or sexual orientation. R.S., 1985, c. C-46, s. 318; 2004, c. 14, s. 1. That's your governments problem not ours! If they can't pay it then maybe they'll just have to give us some uninhabited land in lieu. They made the agreements their Constitution enfoces them. They need to ante up and stop playing games. We already have our culture in a position to prosper in the future. Asking us to simply forget about that which rightfully belongs to us and is constantly being taken by people that have more than enough land (than they need and use themselves) is extremely nothing more than shameless greed!!!

  18. To mean that your treaties stand up? No. It's saying that any gaurntees in the Constitution don't override the treaty. It mentions nothing about your treaty being valid. It is however, a very close clause to what you would have seen in pseudodemocracies like old South Africa. I'm sure they'd have a clause along the lines of "no guarntees in this constition will abrogate special freedoms and rights given to non-coloured individuals." We're all equal expect 'x' racial group, who is better. I can't stand for that. Let me simplify! The guarantee in this Charter of certain rights and freedoms shall not be construed (interpreted) so as to abrogate (repeal or cancel) or derogate (detract from) from any aboriginal, treaty or other rights or freedoms (Proclamations and agreements) that pertain to the aboriginal peoples of Canada including... Section 35 (1). The existing (have being) aboriginal and treaty rights of the aboriginal people of Canada are hereby recognized (realize validity) and affirmed (state as fact). Here is your constitutional validation for aboriginal and treaty rights!

Are you familiar with the following? Covenent Chain Two Row Wampum Treaty of Utrecht 1713, Atricle XV Treat of Paris 1783 Jay Treaty 1794, Article III Treaty of Ghent 1814, Article IX

  23. The gov't has the power to recind any contract or agreement that is not in the public interest - this includes any treaty with any foriegn nation. Doing so will always have political re-percussions which means no gov't should make such a move lightly. However, the gov't always has the power to do it. The only question is whether it is possible to honour these archiac treaties without imposing huge burdens on the non-aboriginal population. If the answer to that question is no then the gov't has all the power it needs to repudiate them. Would you make that argument if the descendents of the orginal white settlers had special rights? Canada does NOT have the power to recind any Native treaty because Canada is not sovereign it is autonomous and under British sovereignty!
  24. Our people welcomed European people here as friends and offered them a place to live as our neighbors. We helped them in times of war when Great Britain didn't have enough troops to send here to defend their people. Without us you'd be either French or American x2! If that doesn't make a difference of what you as Canadian are today then you've got some major denial issues going on. Sharing or compromise to people like you means, we'll take what we want whether you agree or not and we'll break or change the interpretation of the law to suit our whim. When we've been pushed to the point of realizing we can't obtain any honest legal remedy we're called law-breakers and terrorists. That's how "we treat each other today"! I have already refuted your claim with the Nisga'a Treaty but you still keep refering to the Delgamuukw case, which could also still be reversed upon proper appeal and honest legal justice. You're not even offering any good solid evidence for your cause you just continually evade everything with nonsense. Your own Constitution does not contain statutes of limitations on any Native treaties, rights and other freedoms and specifically includes the Royal Proclamation Act of October, 7, 1763! Most of which are over a century old! Section 52 (1) also states that the constitution is the supreme law of Canada! There is also no statute of limitations on GENOCIDE! You're a real piece of work! I can see right through you even though you try to word carefully! Your Constitution and legal system are quite clear as to what is legal regardless of any time lapse. Our people have tried to use your legal system and have failed under its own corruption. When faced with the reality of their law they change or omit the rules of the game. In short we CANNOT obtain any legal remedy within your domestic legal system! You're not about law and justice as you put on you are. Your closing sentence says it all; "there is nothing that can or should be done today." Pretty damn arrogant statement for a person that talks about respect!
  25. Many First Nations and other aboriginals are very much part of Canada. I don't know that there is a united front on this at all. Does the Assembly of First Nations make the agument that they are not part of Canada? Do you have productive solutions to offer to today's problems? The AFN and "Band Council" are a product of the Indian Act. The Indian Act was implemented by the Canadian government in an atempt to destroy our Traditional form of government and take land. At Six Nations it was imposed on us in 1924 by the RCMP at gunpoint. That under the criminal code and international law constitutes an act of genocide. I think alot of non-native misunderstanding of us is due to the fact they are unaware of this and similar issues. The only solution to the problems of today is for the government to be honest and comply with their original agreements instead of trying to use smoke and mirror tactics in an attempt to gain more.
