Why doesn't Premier Campbell call the by-election? We already know Campbell is a lush, but it looks like he is a coward too! In any case I think there should be a law requiring byelections within a certain amount of time in all juristictions. There is a law requiring election so why not byelections? August1991 Posted August 24, 2004 Report Share Posted August 24, 2004 At the federal level, the PM has up to 6 months to fix the date. In effect, we have "fixed" dates for both general and by elections now. According to some, it appears the current fixed dates are too far into the future. In the case of general elections, by bringing the date forward, we would in effect reduce the potential length of mandates. I don't see how this would make Canada more democratic. After receiving the warrant, the Chief Electoral Officer issues a writ for the election of a member of the House. Section 57 of the Canada Elections Act authorizes the Governor in Council to fix the date on which the Chief Electoral Officer is to issue that writ. The date of issuance must fall between the 11th and 180th day after the Chief Electoral Officer received the warrant from the Speaker (or the two members of the House). The Governor in Council also fixes the date for polling day which cannot be earlier than 36 days after the writ is issued by the Chief Electoral Officer. Once someone steps down as a MLA, there should be a by-election within two months at the most. What is the rationale for allowing the Premier to decide? It should be a fixed period just like general elections are now beginning to have fixed term dates. I say Campbell is a coward for not calling the by-election, because he knows his candidate is going down to defeat. That is no excuse, and the voters in Surrey have been without representation for way too long.
