Under bills C-50, C-51 and C-52, which the Conservatives tabled in the last Parliament and reportedly plan to table again this fall, police would be able to collect emails, phone numbers, addresses and other information about Internet users without a warrant.

I tried to create a poll but something went wrong. Anyway I tried to find the other side of this argument but with no success. Do you agree with this Legislation?

I'd like to see the pertinent sections of the legislation, and if it is exactly as reported, so far I haven't seen the bill, or at least the sections of it that do away with requiring a warrant. Is the bill tabled now ?

If it is as reported, then I don't agree with warrantless searches.

184.4 A peace officer may intercept, by means of any electro-magnetic, acoustic, mechanical or other device, a private communication if the peace officer has reasonable grounds to believe that

(a) the urgency of the situation is such that an authorization could not, with reasonable diligence, be obtained under any other provision of this Part;

(B) the interception is immediately necessary to prevent an offence that would cause serious harm to any person or to property; and

© either the originator of the private communication or the person intended by the originator to receive it is the person who would commit the offence that is likely to cause the harm or is the victim, or intended victim, of the harm.

3. The purpose of this Act is to ensure that telecommunications service providers have the capability to enable national security and law enforcement agencies to exercise their authority to intercept communications and to require telecommunications service providers to provide subscriber and other information, without unreasonably impairing the privacy of individ- uals, the provision of telecommunications services to Canadians or the competitiveness of the Canadian telecommunications industry.

Internet surveillance proposals face more scrutiny

The bills from the last session included:

C-50, Access to Investigative Tools for Serious Crimes Act, which would give police the power to intercept private communications without a warrant under certain circumstances.

C-51, Investigative Powers for the 21st Century Act, which would allow police to get warrants to obtain information transmitted over the internet and data related to its transmission, including locations of individuals and transactions; and orders that would compel other parties to preserve electronic evidence.

C-52, Investigating and Preventing Criminal Electronic Communications Act, which would require internet service providers to have infrastructure that will allow law enforcement agents to intercept internet communications of their customers; and provide basic information about their subscribers to law enforcement.

Seems to me that they are simply giving the police the same powers that private citizens have enjoyed for years.

Lawful access, the Conservatives' planned Internet surveillance legislation, has generated considerable attention over the past week as the government decided against including it in their first omnibus crime bill. That decision generated widespread media coverage, claims that the government had backed down in the face of a 70,000 signature online petition, and a debate in the House of Commons in which Public Safety Minister Vic Toews promised that warrantless online wiretapping is not planned.
