ToadBrother Posted March 26, 2010 Report Posted March 26, 2010 It appears a problematic appointment to forstall parliamentary inquiry - where the military has not classified the documents - where people of the given security clearance ought to be granted need to know status. It's not problematic, it is unprecedented and unsupported in our system. The ultimate arbiter on Government actions isn't some government-appointed individual, it's Parliament. Whether this guy is the greatest, most honest, most fair-minded human who has ever walked the Earth is irrelevant. It could be Jesus Christ himself getting to look at those documents, but it means nothing. He has no legal or constitutional standing of any kind. Whether he agrees or not is irrelevant. The Speaker of the House, on the other hand... Quote

Topaz Posted March 27, 2010 Report Posted March 27, 2010 I really think Harper would call an election before an contempt charge could be called on the Tories. After all, he`s the only that can call for an election and get away with it. He won`t prorogue. Quote

After all, he`s the only that can call for an election and get away with it. He won`t prorogue. Than i am guessing we have just days or week before that happens!?? if he calls an election now would it be political suicide for this PMO or the Tories... because you would have The what are they hiding question or the you called an election over that..... or so this is why he prorogue on & on & on... it would go... than there is the small matter of the press itself Quote
Mr.Canada Posted March 28, 2010 Report Posted March 28, 2010 You guys are hilarious. You all seem so convinced that their was wrong doing. You've convinced yourselves as this thread has gone on. Now you all have this tunnel vision. Have you considered that there may not have been any wrong doing? What will happen if this is the result? Will this change your mind on events? After all, he`s the only that can call for an election and get away with it. He won`t prorogue. Then I'd suggest he'd better go about it soon. I'm sure within the next week or or so the Speaker will have made up his mind. Quote

I doubt there was any great wrongdoing. I think it's a big waste of time. However, what I do care about is the continued erosion of Parliament's authority. Parliament, right or wrong, is the ultimate boss, not the Government, and not the Prime Minister. If Parliament wants to see those documents, 300 hundred years of constitutional precedent says that no Government has the least bit of authority to prevent it. But I don't know why I bother explaining things to someone like you, who would probably be happy if Harper set up his own Personal Rule. Quote
ToadBrother Posted March 29, 2010 Report Posted March 29, 2010 who do you think will win this one?? is there a way any of this could go to the supreme court of Canada after all they did retain Iacobucci? All of it depends on the Speaker. Theoretically it could end up in the Supreme Court, I suppose, but first it all has to go through the Speaker. If the Government defies the Speaker, then I have no idea what comes next. Such a thing, I think, would provoke, if not a constitutional crisis, at the very least a serious procedural one. Whether the Speaker could at that point go to the GG or to the SC for satisfaction is something quite beyond me. Quote

ToadBrother Posted April 3, 2010 Report Posted April 3, 2010 will Iacobuccis review be exposed to the SCC anyway as hr is a legal / lorer officer?? He has no standing whatsoever. This is a question of privilege. Like I said before, if Jesus himself came down and said he'd review everything, it would be irrelevant. Either Parliament has the constitutional right to compel the Government to produce any documents at any time or it doesn't, and either the Speaker is the ultimate arbiter of privileges or not. If not, then I posit that, regardless of how justified the Government may be, Parliament has lost its more profound power. Quote
Topaz Posted April 3, 2010 Report Posted April 3, 2010 I think if the Speaker agrees with the oppsition parties about contempt, then the speaker sends someone down to collect all the documents and if the PM refuses I think an election is called. No PM has been that stupid to refuse but Harper is stubborn. Quote

Why don't you look up the canadian ambassador BEFORE David Mulroney. He was VERY GOOD friends with the president of Afghanistan, they even prayed together. He told everyone NOT to write anything down about the detainees. Quote

No PM has been that stupid to refuse but Harper is stubborn. That's a possible outcome. I think it's more dangerous a gamble than a lot of Tories think. I just wish everyone would stop thinking about politics for one moment and ask the question "What is the purpose of Parliament?" Quote
