Charges laid against Caledonia protesters

Nine people have been charged with assaulting a police officer, mischief and trespassing after being arrested Wednesday at the site of an aboriginal protest in Caledonia.

The protesters were arrested at a housing development a few kilometres away from the original site occupied by Six Nations protesters nearly two years ago. It is the same location where there was a violent confrontation last week.

Construction workers resumed work at the Stirling Street subdivision on Wednesday watched over by a small group of native protesters on a nearby hill.

Suspects Sought in Aggravated Assault

On September 13, 2007, a contractor working in the subdivision was

Actually, I believe that because at least one of them had picked up a piece of wood and beat Mr. Gaultieri with it, indicates that theft did occur.

According to one account, Gualtieris planned ahead and brought their own...

Even if your tale of the events are true, which they flat out aren't (common sense eventually has to prevail), I have no issue with people using force to defend their personal property. If a bunch of people snuck into my house, I'd have no problem swinging a bat at them.

Anywhere else in Canada, the law is the side of the person defending their property.

Criminal Code of Canada:

41. (1) Every one who is in peaceable possession of a dwelling-house or real property, and every one lawfully assisting him or acting under his authority, is justified in using force to prevent any person from trespassing on the dwelling-house or real property, or to remove a trespasser therefrom, if he uses no more force than is necessary.

(2) A trespasser who resists an attempt by a person who is in peaceable possession of a dwelling-house or real property, or a person lawfully assisting him or acting under his authority to prevent his entry or to remove him, shall be deemed to commit an assault without justification or provocation.

Because they were there, and didn't leave, the Indian thugs committed an assault. The Gualtieris has every right to use maximum force to get them to leave, probably anything other than lethal force. If a bat is needed to get them out of the house, then start swinging it.

People have a right to their property and have every right to remove anyone they wish from it at any time.

So even if your case is true, the Gualtieris are still in the right and the Indian thugs sent for extortion money are still criminally responsible. Self-defence is not a reasonable defence when your trespasing in someone else's property, you have an obligation to leave regardless of the situation.

This was not at this point a private residence where the Gualtieri's resided, but a house under construction on a site that had been closed to builders by the OPP.

You do have to remember that this goes beyond common law and involves constitutional law.

It is hard to leave when you are pinned to the wall by a baseball bat pressing against your neck.

A house under construction is not a "dwelling" and the courts hold possession, search and seizure laws differently. From what I have read so far, every indication is that Sam Gualtieri initiated the fight, and the young men got the upper hand. One of Sam Gualtieri's nephews has already admitted that they went outside looking for a two by four to use against the youths and when they returned they found Sam unconscious and the youth running down the street. They claim he was beaten with an oak railing picket, yet his injuries don't show a whole lot of facial lacerations or head wounds that would indicate an attck with an weapon like that. Instead, his injuries suggest concussion which would more likely have been caused by repeated blows to the head by a blunt instrument, like a fist. Obviously (or not to the more pedantic posters) his nephews would not have gone out and left Sam alone to look for weapons, if they had of been on the upper end of a fist of cuffs.

I have heard that the only way to stop a Mohawk would be to kill them. Their tenacity in battle is unmatched by no one and reason enough why Mohawk warriors are well respected in both the Canadian Armed Forces and the US Armed Forces. I digress.....

Once again pure conjecture. I don't know about the States but Canada does not employ the Mohawk toy soldiers in any capacity. Go ahead and disagree, I know you will. Once again I will repeat, I did 20 years and six tours, not once did I encounter a Mohawk or ever hear of one in the training system. quite frankly I doubt many of them could meet the requirements, one of which is a grade twelve education.

You guys really get off on this myth of Mohawk invincibility don't you. The fact is that if these ya-ya's went up against a modern well trained military force they'd have a snowflakes chance in hell of survival.

The Mohawk vigilantes were tossed like salad by the R22e at Oka. When the 22e got orders to increase pressure on the vigilates, they crept into their lines (injun style) and beat the crap out of their pickets before hauling them off to the police.

Anyone who works hard and follows orders can earn the respect of the officers of the CF or the US army. But they have to work for it, it is not an inherint indeginous right like welfare.

What I find strange is that these Bozo's consider Oka to be a great victory, some victory.

Our guys were under express orders to minimize damage to the Mohawks. I bet for all there exceptional "woodcraft" they didn't know our boys were watching them from the trees. Amazing how our guys can disappear once they put their Ghillie suits on. As everyone knows, we have some of, if not the best snipers in the world.

We were watching portions of "Rocks at Whiskey Trench" this afternoon at the Quarry with some people and one lady who got pushed into the river and dragged into the bridge abutment. During the rescue as some held her head above the water, and suffering from a broken hip she was lifted onto a stretcher, she still had the fortitude to sit up and raise her hand in disgust at the soldiers that put her there.

Ya that the girl was my cousins kid and sad to say that she cannot have children as a result of her injuries (a broken pelvis) hip and leg.But she has grown alot since then and is a very very strong woman,she makes us proud.

Oh so they were unproven allegations made on a movie.....no evidence though, no charges even.

Tell you what, all aborignal land was given to my four fathers.....who should I call first to tell them I need some cash settlement?

They are Bozo's, a bunch of fools who grant themselves a title with no basis in fact. It takes a hell of a lot more to make a warrior than just a childish desire to be seen as such. A set of used combats from an Army surplus store does not a warrior make.

It takes years of training and discipline to form an effective fighting force, not just strutting around proclaiming yourself to be such. Combat is another component of the process, one I believe these so called "warriors" to be sadly lacking in.

You appear to believe that I equate all Natives to be one and the same as the clown school known as Mohawk Warriors, I dont. As I've stated before, some are very respectable and good people to know.

Don't expect me to give even a moments respect to some self proclaimed Jokers who's entire modus operandi is based upon myth-information. Sorry, cant do it. I spent a good portion of my life in the company of actual real warriors, not toy soldiers.
