Mr. Justice Luc Martineau of the Federal Court last month dismissed the watchdog's allegation that 67 Tory candidates wrongly claimed advertising costs that should have been reported as national campaign expenses.

Conservative Party spokesman Fred DeLorey expressed disappointment that Elections Canada is appealing the ruling.

“Although we are not surprised, it is disappointing that Elections Canada is continuing this after the courts said they were wrong,” Mr. DeLorey said.

“They've already wasted millions of dollars on this.”

So the courts of this land have ruled that there was no in and out scheme but naturally this isn't good enough for the Liberal controlled Elections Canada. Yes, there must be something wrong here, after all PM Harper is evil as are all Tories. They have a hidden aganda and they want soldiers...in Canadian streets....with guns....in Canada oh and of coarse Harper will destroy Canada and Canadian Healthcare and and and and. Well none of it has happened but that doesn't matter we're Liberals, give us power.

also its been appealed to the supreme court we'll here about it again in a year or so... 4 or 5 years after it happened.

Also the court didn't say it didn't happen, they said that even if fraud occurs the Cheif electoral officer is obligated to rubber stamp it and give refunds, it is the responsiblity of the elections commissioner to pursue cases of fraud - and it is a tory appointed position that the elections commisioner is to report to "public prosecutor" appointed by the attorney general who is suppose to proceed with charges - a very bad loophole for electoral corruption to let the government pursue cases of electoral fraud rather than the courts or rcmp. Electoral process should be independant of government veto - otherwise it ain't a free democracy.

Of course, elections Canada does not ask "How high?" when Harper says jump, so they most be controlled by the Liberals, right?

BTW, it is normal procedure for the losing party in a court case to appeal if they think that the judged was wrong. The conservative Party would have done the smae, and it would have been OK for them to do so.

In Parliament the Tories admitted they did it but said everyone of the parties did/do it and so what's the problem. The problem is the NDP and the Libs haven't been charged as doing it! The Tories thought they had a tax loophole, and used it but it wasn't.
