It is not that at all. Allowing on reserve businesses to allow smoking screws off reserve businesses that are not allowed to so. If native reserves want to have free trade with the communities that surround them then they must be prepared to accept regulations set by the community around them.

Gaming is regulated by the province in Manitoba. I don't know how it is elsewhere. If the self-government means any type of law, why not a brothel?

Would non-natives be allowed to work in said brothel?

Harper differed with his party on some key policy issues; in 1995, for example, he was one of only two Reform MPs to vote in favour of federal legislation requiring owners to register their guns.

At any rate, the reason this debate is happening at all is because a Manitoba court stated that the government couldn't exempt reserves from the province-wide smoking law. Smoking is now against the law in public places including casinos and bars on reserves in Manitoba.

It is now being appealed to a higher court.

Does the province have authority in this case?

It appeared it was the Feds from the CBC story earlier in the thread.

The Provincial Government has no authority over smoking on reserves. Only the federal government and the Band Government through the authority of the Indian Act can make laws and by-laws. However, a safety requirement can be extended to a reserve if the Band By-Laws or the Indian Act are silent on the issue.

In this case the Native leaders have instructed each nation to write their own by-laws regarding smoking. All they need do is prescribe that smoking is allowed in any building at any time and the provincial safety requirments can no longer be used.

This has already been tested in Ontario. Ontario lost.

The court in Manitoba struck down the law that exempted reserves. So far the reserves are complying.

The government of Manitoba is trying to get an exemption for the reserves but the feds are saying that provincial law applies.

Manitoba has no jurisdiction.

The precedent has already been set by the SCC for the reasons I cited.

Still, the reserves are complying.
