Aaron Wherry says through Twitter that he was told Chief Justice Beverly McLachlin was consulted by Harper on this appointment. If that is true, it would be an admission of being wrong given his earlier statements about the PMO's relationship with the Chief Justice. Quote

The Prime Minister has the right and responsibility to appoint justices to our Supreme Court. Personally, be it an admission of anything would be a conjecture based on a personal agenda of whoever makes that assertion and is irrelevant to me. It is important that our Supreme Court is fully staffed and staffed by competent and qualified individuals. Clement Gascon appears to satisfy the required criteria.
