NFL Lockout Under Way This has been a bad week for collective-bargaining agreements. National Football League team owners locked out the league’s players Saturday, shutting down pro football for the first time since 1987. The owners took this course of action after labor talks with the players’ union collapsed Friday, with the two sides failing to come to terms on a new collective-bargaining agreement by a set 5 p.m. deadline—their 16th day of mediated talks—resulting in players decertifying the NFL Players Association, and moving the dispute into the courts. After the decertification, the NFL Players Association filed antitrust litigation against the owners late Friday, with star quarterbacks Tom Brady, Peyton Manning, and Drew Brees among the 10 named plaintiffs. Owners have criticized the NFLPA’s refusal to alter its stance on key issues, while the player’s union, headed by executive director DeMaurice Smith, demanded the owners turn over 10 years’ worth of audited financial records. Neither side complied. The central issue is how to divide the $9 billion in annual revenue that the NFL generates. Under the current deal, owners receive $1.3 billion off the top and players get 60 percent of the rest. Owners wanted an additional $1 billion before the players’ share kicked in. I notice you are now down to one situation in Texas. I will wait with baited breath for you to explain, in detail, how the situation in Texas (whenever that may have been) is analogous to the situation in Wisconsin. Of course you will have to show that the law in each state is the same in all material respects.

You bring your own bias to the discussion. It appears the authoritarian model offered by the Republicans appeals to you. Of course polls show the vast majority of those polled view the the actions of Governor Walker and the Republican caucas in a negative light. The model you support excludes proper debate and public input. That may be okay in a banana republic but it shouldn't be for a place that claims to pride itself on espousing freedom and democracy to others.

Spending money on prevention was no more than a “slush fund.” Research on innovation was “an oxymoron.” And there was no reason to pay for “so-called effectiveness research.” To put this in context, you have to realize two things about the fiscal state of America. First, the nation is not, in fact, “broke.” The federal government is having no trouble raising money, and the price of that money — the interest rate on federal borrowing — is very low by historical standards. In your system of democracy the rule of law suggests proper notice is required for such matters. Unless you live in a cave and are unfamiliar with the manner in which bills are introduced and debated you must acknowledge the actions of the Republican caucas in Wisconsin is lacking in every material way. Maybe we should have a discussion about the process to be followed in moving a bill through the various legistative stages.

(3) Public notice of every meeting of a governmental body shall be given at least 24 hours prior to the commencement of such meeting unless for good cause such notice is impossible or impractical, in which case shorter notice may be given, but in no case may the notice be provided less than 2 hours in advance of the meeting.

Thank-you for providing that clip. It would appear to me that, as a matter of law, insufficient notice was given in introducing this particular bill. I don't know whether injunctive relief is available through the courts but it does seem a cause of action is in the making. It is quite shocking to see the disrespect shown by the Republicans in the State of Wisconsin to the democratic process. Clearly in such circumstances the Democrats ought to have been given sufficient notice and an opportunity to review and debate the bill. In our system of democracy legislative bills allow for public input at the committee level and in this particular case that input has been disregarded to date. I look forward to a review by the courts and am hoping the court will consider the bill void ab initio.

Democracy is supposed to be slow. It's supposed to be deliberate. It's supposed to be a process of compromise where neither side gets everything they want nor gives too much. But what happened on March 9th, 2011 in Madison, Wisconsin was anything but democratic.
