Assisted by gun-rights advocacy groups, three individuals who were under 21 challenged a 2003 state law that enacted an age requirement to apply for a permit to carry a pistol. They argued that the law unconstitutionally prohibited young adults from exercising their Second Amendment right to bear arms. In a 50-page ruling, U.S. District Court Judge Kathleen Menendez agreed. Relying on the Supreme Court's 2022 decision in New York State Rifle & Pistol Ass'n v. Bruen, the judge concluded that Minnesota's law was unconstitutional and blocked the state from enforcing it. "Based on a careful review of the record, the court finds that defendants have failed to identify analogous regulations that show a historical tradition in America of depriving 18- to 20-year-olds the right to publicly carry a handgun for self-defense," Menendez wrote. "As a result, the age requirement prohibiting persons between the ages of 18 and 20 from obtaining such a permit to carry violates the Second Amendment." Talking points to ponder. (For those who want to actually DISCUSS this subject and not just delve into namecalling and other id!otic banter.) 1. Age 18 is a person is able to buy alcohol, buy cigarettes, get a tattoo, join the military and (during DEMOCRAT PARTY foreign wars) be DRAFTED to fight those wars. 2. 18 is considered the age of consent. For those of you who have no legal knowledge (and that's not altogether a bad thing) it means an 18 year old is LEGALLY able to consent to something. (Smokes, Beers, Castration for sex reassignment, etc) In law it also means that contracts are enforceable against 18 year olds because they're old enough to consent. Younger people can and do enter into legal contracts. But in event of their committing a breach, the contract cannot be enforced. 3. Of ALL the items on the list: buying booze, smokes, tats, castration, NONE of those items are considered a Constitutional Right. The goose steppers in Minnesota tried to deny the Constitutional right to bear arms to those young adults who are considered liable for their actions as adults.
