charter.rights Posted January 27, 2008 Report Posted January 27, 2008 (edited) The point has flew past you entirely. I don't give a f--ckin damn bout ancestrial land. If we went by that we'd be too tangled up in legal matters of land that never belonged to us. If i screw a native and we have a kid does he have land claims then? Your ancestral claim to title is not the same thing as a Native claim to land. Claim to title is only a right, to which the government and the public holds a greater right. Natives hold ownership of all lands and it is recognized and protected by the Royal Proclamation 1763. There are no property rights entrenched in the Constitution. Ever wonder why? It is because Canada has no ownership of any land, and only holds a right through treaty, or agreement. Your title to land comes directly from the treaty or agreements made with First Nations. In the absence of definitive treaties or if the clarity is in dispute, First Nations can claim back the lands and resources since their aboriginal right to the lands and resources is protected under the Charter. The resources we use is subject to the treaties we signed with First Nations. However, they still own the land outright. Hydraboss Posted February 8, 2008 Report Posted February 8, 2008 Buyer beware! There is a lien on your property that the government didn't tell you about! All Canadians know we live on native land. It is no surprise to anyone without their head in the sand. I own property. I know it is theirs. If they want it (which isn't likely), I will sue the government to recover my investment. It is the government that broke the law by selling land it had no title to. Actually, since you like to point to Canadian law, if what you believe is true and you own stolen land.... ...you're in possession of stolen property and should be charged. You will also have to surrender "their" land and have no right to compensation. So are you going to do the right thing and give them back "their" land?
