Ok I was a little suprised to see that new legilsation is being proposed to force people who are convicted of crimes, (after they have served their sentence) to need to notify the government... before they travel so that the government can provide notice to the foreign government that they are a criminal.

http://www.vancouversun.com/news/offenders+will+need+notify+before+leaving+Canada/8918239/story.html

I seriously question the constitutionality of this one, first off it is extrajudicial punihment, although this is not new with the Harper government, Canadians are suppose to have the right to enter leave or remain in Canada. Normally people are suppose to finish their punishment when they end their sentence... now its indefinite records, and now exit restrictions.

Seems unconstitutional but I'm sure the blood and torture people will be cheering this one on.

Being someone who was wrongly convicted of a crime (not a sexual offence though), I feel sorry for anyone who is wrongly convicted and has their constitutional rights stepped on as a result of this government.

But hey atleast they arn't putting your RCMP file in your passport yet, even your pardons, or discharges, police contacts and other background data.

None the less is this not obviously unconstitutional? enter remain or leave.. that is a mobility right.. why are their preconditions on departure?

Also why just sexual offenders, are other indictable offences just not important to warn foreign governments about? Makes no sense.

It is clearly a breach of the charter as well as standards of human rights codes.

The gov should just move to imbedded data in passport if they are seriously concerned about criminal backgrounds of people, this sexual offenders only stuff is pure bs.

It is just idiocy if you can't trust them on the outside why the hell would you let them out. It is idiocy. Make life setences with no chance of parole if you can't trust them, why the heck do you have varying amounts of time if it doesn't equate rehabilitation.

Get these idiots out of office, the whole basis of justice is absent from their reasoning. Their logic is either they can't be trusted, or they should be punished. Just backward mentality and wholely unhealthy. Give people the option of the death penalty, and keep people who are permanent risk the hell out of general society. This is no nonsense. Keeping the sex offenders in Canada does not help Canadians, if you are worried they might reoffend.

The logic is just a concerted attack against one class of convicted persons, and wholely fails to address the real issue, that is management and warning of public dangers. Sexual offences are not the only type of serious crime. Why exactly are you ignoring murderors, and theives and fixating on the sexual offenders.

At the heart of it though, you should be insuring that people have access to fair trial, and that the level of hearsay, needs to be corroborated with real evidence. The threshold of conviction is too low in Canada to insure fairness in punishment of people on a basis of hearsay. On a basis of he said she said judges are willing to convict and this means wrongful conviction only requires someone to say someone did something, that isn't a safe threshold of conviction to destroy peoples lives, walk over their constitutional and human rights.

It is unforgiveable that a government is so ignorant of thier own civil liberties and protections, and is so willing to victimize its own populace. That is not good government.
