The Supreme Court Has Itself to Blame for Texas Defying Its Orders

Texas Governor Greg Abbott is engaged in a number of legal battles with the Biden administration over immigration. One of them involves Abbott ordering the Texas National Guard to set up razor wire and floating barriers in an effort to deter migrants. The federal government argues that those barriers have also blocked Border Patrol from being able to arrest and process migrants in accordance with federal law. Earlier this month, a woman and two children drowned in the Rio Grande, the river that runs along the border with Mexico. A short time later, when Border Patrol was alerted to two other migrants in distress, National Guardsmen reportedly prevented federal agents from reaching them. In 2023, the Houston Chronicle reported that a Department of Public Safety trooper wrote to his supervisor that officers were told “to push small children and nursing babies back into the Rio Grande, and have been told not to give water to asylum seekers even in extreme heat.

There are many factors that led to this point. One is the reigning Republican ideology of Trumpism, which holds that only conservative electoral victories, conservative laws, and conservative governments are legitimate and must be obeyed—the ideology that led a mob to ransack the Capitol to overturn an election. Another is the steady drumbeat of catastrophizing right-wing propaganda about the recent rise in migrants at the border, which seeks to validate extreme responses, including violence and lawlessness. But even accounting for those two elements, the most significant proximate reason for Abbott’s response may be that four Supreme Court justices sent Abbott an implicit message that they agreed with him.

When the Court sided with the Biden administration, it was a 5–4 split, with Justices John Roberts and Amy Coney Barrett joining the three Democratic appointees. This should have been a unanimous ruling; for more than a century, the Supreme Court has held that the federal government has jurisdiction over immigration law in most cases and that the states cannot usurp that jurisdiction just because they disapprove of federal policy. Abbott is now thumbing his nose at the federal government and, by extension, the authority of the high court itself, and four Republican appointees—Brett Kavanaugh, Clarence Thomas, Samuel Alito, and Neil Gorsuch—are saying: Go right ahead. 

Defying the supremacy clause in the Constitution was the first step in the Civil War. 🤮

Maybe they need to stop trying to cross the border illegally and go through the proper ports of entry.

Not until we hunt down and imprison every last Insurrectionist who either assisted others in or who  stormed the U. S. Capitol and tried to forcibly stop the Electoral College from doing its required task under the law on January 6, the documentation proof of who had been ELECTED POTUS versus who demanded to stay in Office no matter WHAT the law said.

So a woman decides that she'll leave her home, dangerously travel to somewhere that she KNOWS it's not legal for her to by,  Stupidly jump in the water with her baby KNOWING the other side is blocked, she drowns - but somehow the guilty party here in your mind is texas.

I'm sure if enough of them do that then sooner or later the others will figure out it's a bad idea.  But put the blame where it belongs - on the criminal who stupidly tried to break a law and failed.

Have you ever even seen razor wire? It's extremely thin, and that's in the daylight. Using it in a river is the same as intentional murder.  In addition it violates State if Texas Fish and Game rules about putting anything in the waters if the state that will harm naturally swimming fish and other wildlife such as ducks.  Razor wire under water will cut them to pieces as they, like humans, will not be able to see it until it severs a limb or beheads a child.

Especially when our own MAFIA us to blame for those drug cartels in Mexico and all points south. It was WE Americans who began teaching people to grow drugs instead of food. It was Americas demand for oil that had our brutally efficient oil rigs draining their natural resources, it was American loggers and the Georgia Pacific wood company owned loggers at that cutting down their forests and poisoning their rivers mining their minerals and flushing their toxic mine waste down the rivers which destroyed their fish and fisheries. They come HERE because of US.  In fact, because of the large donors to the GOP....the Oil, Wood, and Drug maker industries.  They got filthy rich on the backs of these people and by trashing their countries.  Despite all this, and the obstacles you GOP have thrown in their way to prevent them coming here, they make UT anyway and you know that takes the kind of Courage and Guts that make fine American families who in their next generation often sign up to defend America and you kniwcwhat? I like that kind of courage and determination better than the hate and gutless cowards I see in the GOP.
